It has been 20 years since 'The Probation Act' was enacted on July 1. 1989. 'The Probation Act' has been revised ten times during the twenty years. Also numerous legislations founding probation (including community service orders and lecture attendance orders) have been made and revised during that time. Besides 'The Probation Act' there are probation related legislations such as the 'Criminal Act', 'Juvenile Act', 'Medical Treatment and Custody Act', 'Act on the Punishment of Sexual Crimes ad Protection of Victims Thereof', 'Act on the Prevention of Juveniles from Sexual Abuse', 'Act on the Punishment of Acts of Arranging Sexual Traffic', 'Act
on Special Cases concerning the Punishment, etc. of Crimes of Domestic Violence', 'Act on the Electronic Monitering of Specific Sex Offenders'. The legislative history of these show us the path of development the probation system has went through in the past 20 years. During the past 20 years of this legislative history, the applicatory range of probation has expanded greatly and the range of affairs of probation officers has diversified much too. The systematization of legislations regarding probation has been achieved in a great degree. The applicatory
range of these laws cover the whole procedure starting from indictment, followed by trial and the execution of punishment and ending in rehabilitation service. The importance of probation is emphasized not only in juvenile justice but also in criminal justice. The majority of subjects has
shifted to adults. As it is seen in the implementation of electronic surveillance by position racking, the role of probation has expanded to intra-society treatment of criminals.
Throughout the legislative history of probation, the expansion of intra-society treatment has been the guide of criminal policy. And it is predicted that such policy will be held up in the future. It is crucial that improvements in probation related laws such as the 'Protection and Surveillance Act(Repealed)' are continuously made in accordance of the expansion of intra-society treatments. Especially, plans to guarantee the effectiveness of intra-society treatments and new forms of intra-society punishment should be contrived.

1989년 7월 1일 ‘보호관찰법’이 처음 시행된 이래 우리나라에서 보호관찰제도가 본격적으로 실시된 지도 20년이 흘렀다. ‘보호관찰법’은 지난 20년간 총 10차에 걸쳐 개정된 바 있다. 그 동안 ‘보호관찰법’ 이외에도 보호관찰(사회봉사명령, 수강명령 포함)의 적용근거가 되는 많은 법률들의 제정 및 개정이 이루어졌다. 보호관찰법 이외의 보호관찰 관련 법률로는 ‘형법’, ‘소년법’, ‘치료감호법’(구 사회보호법), ‘성폭력범죄의처벌및피해자보호등에관한법률’, ‘청소년의성보호에관한법률’, ‘성매매알선등행위의처벌에관한법률’, ‘가정폭력범죄의처벌등에관한특례법’, ‘특정(성폭력)범죄자에대한위치추적 전자장치부착에관한법률’, ‘벌금미납자의사회봉사집행에관한특례법’ 등을 들 수 있다.이러한 보호관찰 관련 법률들의 제·개정의 역사는 지난 20년간 우리나라 보호관찰제도가 어떻게 발전했는지를 잘 보여주고 있다. 지난 20년간의 보호관찰 관련 법률들의 제정과 개정을 통해 우리나라에서 보호관찰의 적용영역은 끊임없이 확대되었고, 보호관찰관의 집행‧조사 업무도 매우 다양해졌음을 알 수 있다. 보호관찰 관련 법률규정의 체계화도 상당히 진척되었음을 알 수 있다. 보호관찰 관련 법률의 적용영역은 소추단계, 재판단계, 형벌집행의 단계를 거쳐 갱생보호에 이르기까지 크게 확대되었다. 보호관찰제도는 소년사법은 물론 형사사법내에서도 그 비중이 매우 높아졌다. 보호관찰 적용영역은 시행 초기의 소년위주에서 이제는 성인중심으로 변화되었다. 보호관찰을 부과할 수 있는 보호처분의 종류도 다양해지고, 그 대상도 크게 확대되었다. 또한 보호관찰제도는 - 위치추적 전자감독 제도의 실시에서 볼 수 있는 바와 같이 - 위험한 범죄자에 대한 사회내처우로 확대되기에 이르렀다. 보호관찰의 본격적인 시행 20년 동안의 보호관찰 관련 법률들의 제·개정 역사속에서 사회내처우의 확대가 우리나라 형사정책의 방향타가 되어 왔다고 생각한다.
또한 앞으로도 사회내처우의 확대정책은 지속될 것으로 보인다. 사회내처우의 확대정책에 맞추어 ‘보호관찰등에관한법률’을 비롯한 보호관찰 관련 법률들의 정비작업도 끊임없이 이루어져야 한다. 특히 사회내처우의 실효성을 확보하기 위한 방안과 새로운 형태의 사회내제재수단의 도입에 관한 법률개정작업이 필요하다고 생각한다.
