One of the important objectives of this study is to delineate legal parameters of the usage of hidden-cameras in investigative television programs so that reporters can become aware of legally viable newsgathering activities although the usage of hidden-camera can be seen as unethical. In so doing, this study has analyzed Korean and U. S. cases that are related to the usage of hidden-camera. In analyzing these cases, this study has categorized the areas of analysis in three ways based on the claims plaintiffs have made in court against the media defendants.
The three-fold analyses based on the most common claims for damages include: ①fraud and breach of loyalty that resulted from false representation in employment; ②infringement of the right of privacy through trespass; ③libel and publicity damages due to the televised programs. By examining cases through the three-fold analysis, this study may contribute to delineating resonable legal parameters for the use of hidden-cameras in broadcast investigative journalism.

본 논문은 공공의 이익과 직결되는 이슈에 대한 취재 및 보도를 함에 있어서 비록 비윤리적인 취재방법일지라도 기자나 PD가 몰래카메라를 사용할 때 법적 제재를 받지 않을 수 있는 범위(parameter)를 밝히고자 하였다. 시사고발 프로그램의 보도를 통하여 우리사회의 비리 및 부패가 폭로되고 개선될 수 있는 기회가 많아진다는 것은 궁극적으로 국민의 알권리가 신장되어 꾸준한 개혁이 가능하게 될 수도 있기 때문이다. 몰래카메라 사용의 법적 용인 범위를 밝히기 위해서 본 논문은 몰래카메라와 관련된 미국과 우리나라의 기존의 판례를 분석하였다. 기존의 판례를 분석함에 있어서 본 논문은 몰래카메라 취재 및 보도로 야기된 여러 가지 침해의 유형, 즉 ①위장취업에 따른 사기죄(fraud) 및 피고용인으로서의 고용인에 대한 신의파기죄(breach of loyalty) 적용 가능 여부, ②무단침입에 따른 사생활 침해, 그리고 ③보도된 내용에 의한 명예훼손 및 초상권 침해 등 몰래카메라의 피사자(被寫者)가 된 원고의 소송 청구취지가 된 주장들을 3가지로 유목화하였다. 본 논문은 이러한 분석을 통하여 몰래카메라의 사용에 따른 합리적인 사법적 판단의 준거를 검토하는데 조금이라도 기여해보고자 하였다.
