This study reviews the development of drug policy in Germany during the past three decades, particularly focusing on drug legalization. The study then addresses the problems of drug prohibition policy and the potential and challenges of drug legalization policy that is initiated as an alternative of drug prohibition policy in Germany in the 1990s. More specifically, the study first describes the trends in drug use and the history of drug control with respect to heroin. In the next section, the study investigates the features and the challenges of drug prohibition policy. In the third section, drug legalization is reviewed in terms of the theoretical underpinnings, the model, and the cases in Germany. The potential and challenges of drug legalization pertaining to improvement of quality of life for drug users, development of drug culture, and aid for drug users are further discussed. In the final section the study draws implications for Korean drug policy and aid for drug users.

본 논문은 지난 30년간의 독일 약물정책의 발전과정을 주로 약물합법화라는 관점에서 분석하였다. 독일의 전통적 약물정책인 약물금지정책의 문제점과 약물금지정책에 대한 대안으로 1990년대부터 본격적으로 등장한 약물합법화론의 가능성과 한계가 분석되었다. 먼저, 독일의 약물사용실태와 약물통제의 역사적 발전을 헤로인을 중심으로 살펴보았다. 둘째로, 전통적 약물정책의 특성과 그의 문제점들이 분석되었다. 셋째로, 약물문제의 해결을 위한 대안으로 제시된 약물합법화론의 이론적 배경, 약물합법화 모델의 내용, 독일의 약물합법화 경험이 분석되었다. 또한, 약물합법화의 가능성과 한계가 약물중독자의 삶의 조건의 개선, 약물문화의 형성, 그리고 약물복지서비스의 관점에서 검토되었다. 마지막으로, 독일 약물합법화론에 대한 분석이 우리나라의 약물정책과 약물복지서비스에 주는 시사점을 논의하였다.
