Nowadays frequent disputes have been raised on political neutrality of civil servants in South Korean society. The governmental authorities had shown their tendency to suppress civil servants' political neutrality only by the control means based on standardized criteria. More fundamental and objective understanding, however, of their political neutrality should be needed to resolve this problem. In spite of this approach's necessity, some level of structural examinations are still to be left. The purpose of this study is to examine the permitted limit of political freedom of civil servants, through reviewing the institutional characteristics of career civil servants system with its substantial content being political neutrality and analyzing the correlativity between political neutrality and political freedom of civil servants. And this study also reexamines the neutrality of the state, which has been recognized as a subject in judging and determining the observance or violation of the civil servants' duty of political neutrality. In conclusion. the civil servants' political neutrality should be applied as a principle of tolerance approving their political freedom with some restraints at need, not as a control means of their political freedom.

오늘날 우리 사회에서 공무원의 정치적 중립과 관련한 분란이 빈발하고 있다. 정부 측에서는 획일적인 기준에 의해서 오로지 통제수단으로 억압하려고만 하고 있다. 그러나 이 문제를 해결하기 위해서는 공무원의 정치적 중립에 대한 이해를 명확히 할 필요가 있고, 분쟁의 원인 가운데에는 다소의 구조적인 문제도 놓여있다고 본다. 따라서 본 논문에서는 정치적 중립성을 본질적 내용으로 하는 직업공무원제도에 관해서 검토하고, 공무원의 정치적 중립성과 공무원의 정치적 자유의 상호관계를 분석하여 공무원의 정치적 자유를 어디까지 허용할 것인가를 고찰하며, 아울러 공무원의 정치적 중립성 의무 위반여부를 판단하는 판단주체 또는 결정주체로서의 국가의 중립성 문제를 다루었다. 결국 공무원의 정치적 중립이란 공무원의 정치적 자유를 통제하기 위한 수단이 아니라, 공무원의 정치적 자유를 용인하되 필요에 따라 적절한 제한을 하는 관용의 원리로서 적용되어야 할 것이다.
