This paper has attempted to investigate the main cause and controversy in academic plagiarism and propose an improvement plan. For this, this paper has analyzed the cause of academic plagiarism from the ethical and copyright-infringement perspective based on related laws and regulations, guidelines and experts’ opinions. Specifically, the cause of plagiarism is analyzed through ①identification and ②‘Five Ws and One H’-based analysis. Then, an improvement plan is proposed after identifying controversial issues. The major controversies include ①whether or not research misconducts such as fabrication of data and falsification of data are included in plagiarism, ②scope of self-plagiarism and ③ambiguity in the scope of quotation of sources from an ethical perspective. From a copyright-infringement perspective, on the contrary, they include ①a dichotomy (idea/ expression)-related problem, ②ambiguity in quotation standards that assess if fair practice can be admitted, ③vagueness in decision criteria with regard to theft-related ‘conformity relation’ and ‘substantial similarity’ and ④the opposite opinion on plagiarism between ethical and copyright-infringement perspectives with regard to the use of contents whose copyrights are unprotected.

본 연구는 학술논문의 표절 원인과 그 주요쟁점을 고찰하여 개선방안을 제언하기 위해 수행되었다. 연구자는 관련법과 규정, 가이드라인, 학자들의 견해 등을 토대로 학술논문에서 나타날 수 있는 표절의 원인을 윤리적 관점과 저작권 침해의 관점에서 파악하였다. 구체적으로는 ①연구윤리 관련법과 규정, 가이드라인, 학자들의 견해를 통해 표절 원인을 식별하여, ②이를 “five Ws and one H”에 의해 분석하는 방법으로 표절 원인을 파악하였다. 그리고 이를 토대로 논쟁 요소를 식별하여 개선 방안을 제언하였다. 주요 쟁점은 윤리적 관점의 쟁점으로는 ①위조․변조 등 여타 연구부정행위의 표절 포함 여부, ②자기표절 범위 ③타인의 저작물 인용 범위의 모호성 등이며, 저작권침해 관점의 쟁점으로는 ①아이디어/표현 이분법과 관련된 문제, ②공정한 관행과 양립하는지를 판단하는 인용 기준의 모호성, ③도용 관련 “의거 관계”와 “실질적 유사성” 판단 기준의 모호성, ④저작권이 보호되지 않는 저작물의 사용에 대한 윤리적 관점과 저작권침해 관점 간의 표절에 대한 상반된 견해 등이었다.
