According to Korean Commercial Code(KCC), the carrier shall be liable for any loss or damage to the goods and delay in delivering. But in no case shall the liability of the carrier exceed the real value of the goods at the place and time of that delivery was made or should have been made. I think, there are several problems this clause.
The value of the goods at place and time of that delivery is entirety compensation for damages. And this clause is discretion provision. Moreover in case where the extra-contractual liability for loss, damage or delay of one of the persons for whom the carrier is responsible is in issue, such person may not avail himself of the provisions of this KCC which exclude the liability of the carrier or which fix or limit the compensation due, That is the problem in comparison with foreign legislation. So, I suggest that adopt a sum of money limitation of carrier's liability. And the carrier avail himself of the provision fix or limit the compensation, when a consignor claim responsibility of unlawful act. Lastly, I think, the carrier of multimodal transport of goods should be responsible for the uniform liability system.
