Industrial Innovation and Competitive Strategy: Economic Implications of Patent Sharks

Growth in the number and complexity in advanced technology has led many researchers and practitioners to delve into the relationship between industrial innovation and competitive strategy with the special emphasis on the social and economic implications of patent system. In this regard, there have been acrimonious debates on patent sharks which influence the far reaching suggestions for the reformulation of patent system. In this study, we try to understand the emergence and business model of patent sharks from a theoretical perspective. To this end, we firstly delve into the two phenomenological cases regarding patent sharks - burgeoning 'Blackberry' related litigation case and the more recent 'Buy-In-Now' related lawsuit. Based upon these case studies, we proceed to review two opposing arguments regarding patent sharks, and then try to interpretate the patent sharks' business model from both managerial and economic perspectives. Finally we tentatively emphasize the potential of positive functions patent sharks can play in the evolving market for technology.

본 연구는 산업혁신과 경쟁전략의 상호관계를 특허제도의 전략적 활용이라는 관점에서 접근한다. 특히 최근 국내외적으로 치열한 논쟁의 대상이 되고 있는 특허상어의 출현을 이론적으로 이해하려는 시도이다. 이를 위해 먼저 특허상어 논쟁의 출발점이 된 블랙베리 서비스 관련 분쟁특허분쟁 사례와 함께 특허상어의 활동에 대해 법률적으로 제약이 가해진 온라인 경매에서의 바로구매 관련 특허분쟁 사례를 심층적으로 살펴본다. 이를 바탕으로 특허상어에 대한 학계의 주류적 시각인 비판론과 비교적 최근에 법학계와 경영학계의 일부에서 제기되는 긍정론을 비교해서 검토한다. 또한 특허상어의 출현 및 그들의 비즈니스 모델을 이론적으로 해석하기 위하여 첫째, 경영학 분야의 기술전략 문헌을 토대로 특허상어의 활동이 갖는 기술시장에서의 시사점 및 전략적 선택을 분석해보고, 둘째, 경제학의 산업조직론 분야에서 제시된 신호왜곡 이론을 적용한 모형을 분석한다. 특허상어의 출현 초기부터 제기되기 시작한 부정적 비판에도 불구하고 본 연구는 특허상어의 출현과 활동이 이론적으로 설명 가능한 합리적 경제 행위로 해석될 수 있음을 강조하고, 특허제도를 중심으로 한 기술혁신의 촉진 과정에서 특허상어가 수행할 수 있는 긍정적인 역할에 초점을 두고 논의한다.
