This study is to establish the criteria of right based on the law's rule about the security of teacher's status and on the basis of this, the study is also to draw the improvement of the education of Korea by analysis the cases from an education point of view. For the research, the study on records and cases has been done and the improvement plans which are the
result from the analysis of the research are as follows.
First, it is necessary to extend the choice's right of teachers and of educational contents. Second, it is necessary to distribute the guidelines on student's disciplinary punishment or disciplinary action to the teachers.
Third, it is necessary to distinct the official reprimand of the teacher's personal management which on the line of punishment criterion. Fourth, it is necessary to apply the reasons for retrial inclusively to the Appeal Commission for Teachers when one is wish for the review. Fifth, it is
necessary to include good offices, build bridges, and arbitration in the area of the Appeal Commission for Teachers. Sixth, it is necessary to recognize the teacher's public service diseases or accidents inclusively. Seventh, it is necessary to establish the remuneration system to include and motivate the teacher's specialty improvement actively.

본 연구는 교원의 신분보장에 관한 법규정을 토대로 준거권을 설정하고자 하며, 이를 토대로 판례를 교육적 관점에서 분석함으로써 한국 교육의 개선방안을 도출하고자 추진되었다. 이를 위해 문헌 및 판례연구 등을 실시하였으며 이 과정을 거쳐 연구된 분석을 통해서 개선방안을 마련하면 다음과 같다. 첫째, 교원의 선택권과 교수내용의 재량권을 확대해야 한다. 둘째, 교원에게 학생의 징계나 처벌에 관한 안내서를 배포할 필요가 있다. 셋째, 교원의 인사 상 징계는 징계사유에 따른 징계 기준을 명료화할 필
요가 있다. 넷째, 교원소청심사위원회에 재심할 수 있는 재심사유를 포괄적으로 적용 할 필요가 있다. 다섯째, 교원소청심사위원회의 영역을 알선, 중재, 화해기능까지 포함 할 필요가 있다. 여섯째, 교원의 공무상 질병이나 재해를 포괄적으로 인정할 필요가 있다. 일곱째, 교원의 전문성 신장을 적극적으로 유도, 촉진할 수 있는 보수체계를 구축해 나가야 할 것이다.
