This study fundamentally starts from the basic question of ‘what are the rights of the children?’ An admittance and expansion of the children's rights are the historical trend on the basis of the history of advancement in human rights. However, the subject upon the rights of children, due to particularity of children's status, are still observed to leave challenging problems unsolved. This study explores the overall context of securing the children's rights and provides logics necessary in establishing a system, which can properly and appropriately implement the children's rights by analyzing the details of the rights shown in the implementation of convention on the rights of the child that can be said to be the body of systematic progress. The study is also aimed at suggesting practically systematic and political protocol for expansion of the children's rights.
This study has separated the children's rights shown as provisions of the convention into 8 clusters and attempted to operate detailed and in-depth discussions. Thereby the conclusion derived from the discussion are as follows.
Firstly, in discussing the children's rights, a child is defined as an individual who is ‘less than 18-year-old' as generally standardized in the convention. However, it is important to note that the term can be referred differently in accord with various situations.
Secondly, it was possible to understand that the development of a child also as a subject with dignity as a human-being through consideration of historic and systematic advancement of the children's rights as well as to acknowledge the change in status of a child.
Thirdly, there was an attempt in identifying the current status of contexts of the children's rights and realization of their rights through analyses of the nation reports upon the implementation of convention on the children's rights. It was difficult to understand the execution of the children's rights since the report submitted twice consecutively in order to execute the convention was primarily comprised of legislations related to legal, systematic and political plans and an array of the statistics. Nevertheless there was an insufficiency in identifying systematic and social factors that make the execution challenging.
Therefore, in order to conduct the realization of practical and detailed children's rights and the execution that sufficiently satisfies the convention, it is critical to systematically construct a structure which allows the improvement of a law, constituted systematic scheme, rights education as well as a constant expansion monitoring of public relations.

본 연구는 기본적으로 ‘아동의 권리란 무엇인가’라는 기본적인 질문에서 시작된다. 인권 발전의 역사에 비추어 보아 아동의 권리를 인정하고 확대해 나가는 것은 역사적 추세이다. 그렇지만 여전히 아동의 권리라는 주제는 아동 지위의 특수성으로 인해 해결되기 어려운 문제를 남기고 있음도 발견할 수 있다. 따라서 아동 인권 보장의 전체적인 맥락을 살펴보고 유엔아동권리협약(이하 협약)비준국으로서 제출한 1, 2차 국가보고서의 내용 분석과 비교를 통해 아동의 권리 내용을 밝히고 이행의 개선을 위해 필요한 법적ㆍ제도적ㆍ정책적 대안을 제시하고자 하였다.
본 연구는 협약의 조항에 나타난 아동 권리의 영역을 8개의 영역(cluster)으로 구분하여 구체적이고 심도 있는 논의를 진행하고자 노력하였다. 따라서 이러한 논의진행에서 얻은 결론을 제시하면 다음과 같다.
첫째, 아동의 권리를 논함에 있어 협약의 규범력상 기존의 일반적 논의와 마찬가지로 ‘18세 미만의 자’를 아동으로 정의하지만 논의의 상황에 따라 그 의미하는 바가 다름을 밝혀 두고자 한다. 둘째, 아동 인권이 보장의 사상적, 제도적 발전 과정의 고찰을 통해 아동도 인간으로서의 존엄성을 가지는 주체로 발전한 것이 역사의 흐름이라는 것을 파악할 수 있었고 아동의 지위 변화도 알 수 있었다. 셋째, 아동권리협약 이행에 관한 국가보고서 분석 결과, 국가보고서는 협약의 이행을 위하여 정부가 취하고 있는 법적, 제도적, 행정적 조치에 대한 서술 위주로 관련 법규와 통계의 나열이 대부분이어서 아동 권리의 이행에 대한 파악에 어려움이 있으며 그 이행을 어렵게 하는 제도적, 사회적 배경 파악에도 부족함이 있다.
따라서 보다 실제적이고 구체적인 아동의 권리 실현과 협약의 충실한 이행을 위하여 법, 제도적 행정적 체제의 개선과 권리교육 및 홍보의 확대 지속적인 모니터링이 이루어질 수 있는 체계적인 체제 구축이 필요하다.
