This study examines crimes among the elderly in Korea compared with those in Japan. Korea
and Japan have experienced the increase of the elderly population, change of family structure
and economic conditions among the elderly, resulting in aging society. Traditional extended family system has been replaced by nuclear and single family in Korea and Japan. Extension of
life could be economic burden for aging life, thus the elderly seek employment in the decline of
life. As view of Sampson and Laup's developmental life-course theory and Merton's anomie theory, proliferating of nuclear family and seeking employment in the decline of life explain murder, robbery, rape, arson, assault(as a violent crime), theft and fraud(as a instrumental crime) among the elderly. Property crime among the elderly could be explained in terms of Merton's anomie theory. The aggravated economic burden among the elderly in Japan has influenced on the rapid increase of theft in Japan, especially over 70 year-old population. Theft
has not remarkable increased among the elderly in Korea, but there is a possibility of application of Merton's thesis for recent rapid increase in over 70 year-old population.

이 논문은 노인인구 증가로 인해 최근 사회문제가 되고 있는 노인범죄 증가현상을 분석해 보고 그 추세와 원인을 기존의 범죄학 이론을 통해 설명해 보았다. 특히 이 연구에서는 Sampson과 Laub의 발전이론의 견지에서 노인인구비와 가족관계에서 부부가구와 단독가구의 증가로 인한 가족관계의 변화나, 사회유대의 측면을 통해 연령에 따른 노인범죄의 지속과 중지를 설명하였고, Merton의 아노미이론을 통해 경제생활에서 노인인구의 구직희망과 실제 생활에서의 제도적 수단의 결여로 인한 범죄증가의 원인을 추론하였다. 연구 결과는 Sampson과 Laub의 논의에서처럼 가족구조의 변화로 인한 유대의 약화는 노인인구 증가율 이상의 노인범죄 증가를 야기하고, 일본에서의 재산범죄의 급격한 증가는 부부가정과 단독 세대의 증가 및 구직의 어려움으로 인해 상대적으로 제도적 수단을 획득하기 어려운 70대에서의 증가가 두드러지게 나타났다는 점에서 Merton의 아노미이론으로 설명될 수 있다. 한국은 재산범죄에 있어 뚜렷한 변화를 보이지 않았으나, 최근 71세 이상의 재산범죄 증가를 통해 Merton의 아노미 이론 적용가능성이 어느 정도 있음을 보여주었다.
