This thesis focuses on the issue of ‘freedom’ and ‘rights’ in Confucianism and attempts the encounter of Confucianism and feminism by arguing this on the viewpoint of feminism. This thesis will first observe how the issue of freedom and rights is different in the tradition of Confucian philosophy and in the tradition of Western Liberalism, then will discuss how this can be understood from the viewpoint of feminism. The thesis will also bring about the theory of Lee Chi (1527-1602) as one method of overcoming the limits of traditional Confucianism because we can discover a very different style of assertion from the Lee Chi's argument on individual, private desire, and so on.This kind of attempt is made because it serves as a method to criticize how Confucian philosophy is oversimplified by ignoring its intricate configuration and recognizing it as just one category. This thesis will introduce how there is a variety of approaches toward the issues of individual and community, freedom and rights, and etc. as they are placed in the same category of Confucianism, and will understand this in the point of feminism.

이 글은 유가 철학에서의 자유와 권리의 문제에 주목하고, 이를 여성주의의 입장에서 논의함으로써 유교와 여성주의의 만남을 시도하고자 하였다. 논문은 우선 전통 유가 철학에서의 자유와 권리의 문제가 서구의 자유주의 전통에서의 그것과 어떻게 다른가를 살펴보고, 그것이 여성주의 입장에서 어떻게 이해될 수 있는가를 논의한다. 그리고 전통 유가 철학이 지니는 한계를 극복하기 위한 하나의 방편으로 명말 이지(1527~1602)의 사상을 들여온다. 이지의 개체성, 개인의 욕망 등에 대한 논의는 전통 유가 철학에서의 자유, 권리에 대한 논의 방식과는 매우 다른 내용을 보여주기 때문이다. 이 같은 시도를 하는 이유는 유가 철학을 단지 하나의 범주로 인식함으로써, 그 안에 놓이는 복잡한 지형을 무시하게 되는 오류를 범하지 않기 위해서이다. 유가 철학이라는 동일한 범주 안에 놓이면서도 개인과 공동체, 자유와 권리 등의 문제들에 대한 다양한 접근이 있었음을 소개하고, 이를 여성주의 입장에서 파악해보려는 것이다.
