This study aims to examine what motivates the Congress to delegate its legislative power to the bureaucracy, finding out its political consequences. It studies and compares the case of U.S. and that of Korea based on the theory of Fiorina. In short, it finds that representatives try to entrust the law-making activities to the bureaucracy to avoid their involvement into the delicate situations that might result in controversy, remembering their prime concern is to be re-elected at the following election. That is the reason why the size and the power of the bureaucracy become bigger and bigger in both countries altogether. It raises such problems as legitimacy of law-making and representation of constituency in the congress, hurting the principle of representative democracy. To overcome such a predicament, it is recommended that the Congress to reactivate its function of legislation activities and positively participate in the enactment process in the parliament. This is the way to induce the bureaucratic decision and implementation of the law in accordance with the preference of Congress .

본 연구는 의회의 고유기능인 입법권이 관료에게 위임되는 원인과 이에 따른 정치적 결과가 무엇인가 알아보는 것을 목적으로 삼고 있다. 이를 위해 피오리나의 이론과 주장을 토대도 미국의 경우를 살펴보았고, 같은 방법으로 한국의 경우를 살펴보았다. 두 나라 의원들은 재선이라는 근본적인 정치적 목표를 달성하기 위해 논쟁의 소지가 높은 입법 활동에 소극적이며, 이에 입법권을 관료에게 위임하고 있다는 것을 알 수 있었다. 이러한 결과로 인해 두 나라에서 공통적으로 관료의 권한 증대와 관료의 팽창이 발생하고 있다는 것을 알 수 있었다. 이는 궁극적으로는 대의 민주주의의 원칙의 훼손을 가져와 정통성 및 대표성 등의 문제를 자아내고 있다. 이러한 문제 해결을 위해서 의회에 의한 적극적인 입법 활동이 요구되고 있으며, 정치적 통제를 통해 관료의 결정 및 집행이 의회의 선호도에 상응하도록 하여야 한다.
