Until this time, The argument of death penalty is concentrated upon abolition or maintenance of death penalty. but, these dispute are meaninglessness. Because the theory of abolition of death penalty is ideal, but the theory of maintenance of death penalty is reality, so the argument between abolition and maintenance of death penalty can not deduce concurrence. As the contention of Death Penalty System has been made of the controversial point in that system, ultimately the argument between abolition or maintenance of death penalty will arrive at the theory of abolition of death penalty. So it is important to show the Condition of Death Penalty-Abolition as the solution of a defect in Death Penalty System. In this study, the writer suggest that reduction of death penalty articles, device of death penalty sentencing bases, legislation of extraordinary legal procedure, establishment of institution only for the prisoner sentenced death and etc.

사형제도는 그 자체의 위상에 비하여 상당부분 왜곡되고, 역할에 상응하는 대접을 받지 못한 형벌이며, 형법이 규정하고 있는 형벌가운데 가장 불안정한 지위에서 존치되고 있다. 형벌의 유용성에 대한 비난이 있을 때마다 사형제도는 그 정점에서 모든 비판을 받아야 했다. 집행방법이나 집행관, 피해자의 문제 등은 별론 으로 두고 사형제도 만큼 큰 역할을 한 형벌이 있을까? 대다수의 형법학자들은 나름의 견해를 들어 사형의 존치나 폐지를 주장해 왔다. 학자가 아니더라도 사회적인 문제가 되는 흉악범죄가 발생하면 사형의 존폐논쟁은 신문과 방송을 통해 부각되고, 골목길 상점의 소주잔에서도 이야기된다. 나의 의사와 무관하게 우리는 사형에 대해 한마디 던져왔고 아직도 끝나지 않은 이 이야기는 또 언제든지 시작 될 수 있다. 우리나라는 최근 10년간 사형을 집행하지 않았다. 이러한 이유로 국제사면위원회에서는 한국을 사실상의 사형폐지국으로 분류하였다. 국제적인 추세가 사형제도를 폐지하는 쪽으로 움직이고 있어 법률상, 제도상의 폐지를 향한 준비과정의 하나로 보여 진다. 그렇다면 한국에서의 사형제도의 폐지는 형사처벌 규정에서 사형이라는 용어를 삭제하는 것으로 해결되는 것일까? 사형의 존폐의 쟁론에 앞서 사형폐지를 위한 조건을 먼저 고민해보는 것이 중요할 것이다.
