The topic of this research is investigating the current situation and factors of the Taiwanese enterprises to invest in China. We adopted the literature review method to analyze the motivation, investment amount, investment areas, invested industries of the Taiwanese enterprises to invest in China, the contemporary law and regulation in China, and the backflow of the Taiwan enterprises from China to Taiwan. Since 1980’s, affected by the worseness of investment environment in Taiwan and the change of international factors, the inducement to invest in Taiwan no longer exits. China became an important base of global investment for Taiwan enterprises. Because of the close‐related culture and geographic position, speaking of same language, cheaper labor and land costs, abundant of natural resources and the maturity of investment environment, numerous Taiwanese enterprises went to China for investment. For the last 20 years, the amount of investment in China had reached 80% of the investment abroad by the Taiwan enterprises which revealed the tight dependence for economy and trade between the both side of the straits. Although there is a huge market in China, since 2008, in order to promote the domestic economic development, Chinese government changed the regulation for foreign investors to invest in China, such as investment policies, trading regulations (the revised business income‐tax law and working‐contract law), increasing taxation and reducing benefits which forced many Taiwan enterprises move to South‐East Asia or other area, or even flew back to Taiwan Even there is full of opportunities, on the other hand, the risk is also higher, Taiwan business men should be cautious to invest in China in the future. Besides speaking of the same language between Taiwan and China, the relationship across the straits were affected by the sensitive political issues. After the 2008 presidential election, the elected President Ma will have adjustment on the economic and trading policy across straits in large scale. The Taiwan enterprises will face the new challenges for overall arrangement in China.

본 연구는 대만기업의 중국대륙 투자 현황에 대해 검토하고자 하며, 문헌분석의 방법으로 대만기업의 중국대륙투자 동기, 투자금액, 투자지역, 투자분야 및 중국대륙의 새로운 법규와 대만기업의 회귀(回流)하는 현황 등에 대해 분석하고자 한다. 1980년대부터 시작하여 대만의 기업들도 자체적인 투자환경의 악화와 국제적인 요소 변동의 영향을 받아 대만의 투자흡인요소가 사라지게 되었다. 그렇지만 중국 대륙은 대만의 기업들이 세계적으로 투자를 진행하는 중요한 거점 중의 하나로 되었다. 왜냐하면 양안(兩岸)의 문화와 지리적 위치가 비슷하고 언어도 통하며 게다가 중국대륙은 광대한 인구를 갖고 있으므로 상업적인 기회는 무한한다. 따라서 이러한 여러가지 요소들이 대만기업들로 하여금 중국 대륙에 투자를 하도록 촉진하였다. 통계에 따르면, 대만기업들이 중국 대륙에 투자를 진행한 20여년 동안 지금까지 대만기업의 대중국 투자는 대만의 전체 대외투자의 80%를 차지하고 있으며, 이러한 것은 양안간의 경제무역의존도가 아주 밀접하다는 것을 나타내고 있다. 비록 중국 대륙은 광대한 시장이 있어 해외투자를 진행하기 좋은 지역이지만, 중국은 국내경제발전을 촉진하기 위하여 외국투자자에 대한 규정상에서 변화를 가져오고 있다. 예를 들면, 투자정책, 무역법규(예를 들면, 신기업소득세법과 신노동계약법), 세금증가와 우대정책 약화 등 변화를 보이고 있다. 이는 여러 외자기업들로 하여금 어려움에 직면하게 하였으며, 점차적으로 동남아시아와 기타 지역으로 전환하는 계기가 되기도 하고 또는 대만으로 회귀하는 현상들이 나타나게 되었다. 그러므로 중국대륙은 비록 기회가 많지만 상대적으로 위험이 비교적 높아 대만기업들은 중국 대륙에 투자를 진행할 때 반드시 신중해야 할 것이다. 여기에 일부 비교적 엄숙한 과제들을 안고 있다. 예를 들면, 새로운 기업소득세법과 노동계약법의 실시, 인민폐의 가치상승, 거시적인 조절관리와 FDI전체적인 발전동태 등은 모두 대만기업들이 중국대륙에 투자하는 의지와 지역선택에 영향을 끼치게 된다. 대만과 중국 대륙 간에는 같은 문화 같은 민족으로서 언어가 서로 통하는 외에 양안의 관계도 줄곧 민감한 정치화제로 되어왔다. 그 뿐만 아니라 올해(2008) 대만의 대통령선거 이후 마잉쥬가 새로운 총통으로 취임하면서 양안의 경제무역정책에 대해 대폭적인 조정을 진행하게 될것이며, 대만기업들의 중국대륙 투자는 새로운 도전에 직면하게 될 것이다.

本研究之研究主題在探討影響台商赴大陸投資現況之探討；本研究採文獻分析方法，來分析台商赴大陸投資發展的動機、投資金額、投資地區、投資行業別，以及大陸新的法規與台商回流之現況等。從 1980 年代開始，台灣的企業也受到本身投資環境惡化和國際因素變動的影響，導致台灣的投資誘因不再。而中國大陸便是台灣廠商投資全球化的重要據點之一，因為兩岸的文化和地理位置相近，語言相通，加上大陸擁有廣大的人口，商機無限，種種因素下促使台商赴中國大陸投資。台商赴中國大陸投資，約有 20 餘年頭，統計至今台商赴中國大陸投資佔台灣對外投資的八成，顯示出兩岸之間經貿依存度的緊密性。雖然中國大陸有著廣大的市場，是海外投資不錯的選擇，但中國為了促進國內的經貿發展，對於外來投資者的規定將有所改變，如投資政策、貿易法規（如新企業所得稅法與新勞動合同法）、增加課稅和降低優惠等，使得許多外資企業廠商受困其中，並有逐漸往東南亞、其他地區發展，或是選擇回流至台灣的現象，因此，中國大陸雖然充滿機會，但相對的風險也較高，未來台商佈局中國大陸必須謹慎為之。2008年是中國大陸的關鍵年，有大家期待已久的北京奧運的舉行，還有一些比較嚴肅的課題，如企業所得稅法與新勞動合同法的實施、人民幣升值、宏觀調控和FDI整體發展動態等，都會影響台商赴大陸投資的意願與區位選擇。台灣與中國大陸之間除了是同文同種，語言可相通外，兩岸的關係也一直在政治敏感話題間遊走，而且，在今年（2008）台灣總統大選後，由馬英九先生當選新任總統勢必會對兩岸的經貿政策做大幅的調整，台商佈局大陸將面臨新的挑戰。
