The trade facilitation concept of PTAs has evolved from limited provisions on customs issues to include more comprehensive provisions on regulatory and border issues affecting the movement of goods across borders. In addition, although the convergence of these provisions in terms of the subject matter and language of PTAs is increasing due to the influence of the WTO TFA, it is also unavoidable that significant differences remain. The use of technology is supporting the modernization of customs, other regulatory and border agencies and expanding the scope of trade facilitation provisions. In particular, many countries are exploring the use of new technologies such as blockchain to support international trade and border management activities. In modern free trade agreements, a number of developments are taking place simultaneously to modernize and simplify the administration of preferential rules of origin. As customs administrations in each country make better use of automation concepts and build risk management and post-clearance audit capabilities, customs administration business processes will become more sophisticated. The modernization of customs administration is also likely to have an impact on the customs union, especially customs and tax collection. It is analyzed that the process, reporting and documentation requirements will be further simplified.
PTA의 무역 원활화 개념은, 관세 문제에 대한 제한된 조항에서부터 국경 간 상품 이동에 영향을 미치는 규제 및 국경 문제에 대한 보다 포괄적인 조항을 포함하는 방향으로 발전해 왔다. 이는 선진국과 개발도상국 모두의 계약 당사자에게 해당되며, PTA로부터 얻는 이익을 최적화하기 위해 무역 원활화 조항을포함시켜야 한다는 필요성이 점점 더 깊이 인식되어지고 있다. 무역원활화 개념의 확장과 PTA에 포함된 무역원활화 조항의 수는 여러 가지 요인에 기인하고 있다. 여기에는 무역 원활화에 대한 인식과 이해를 높인 WTO 무역 원활화 협정 협상이 포함되어 있으며, 이협정은 발효 전부터 PTA의 무역 원활화 조항 협상에 유의미한 영향을 미쳤고, 앞으로도 지속적으로 영향을 미칠 것이라고 판단되어진다. 무역 원활화 개념의 확장은 협정에 포함된 평균 조항 수의 증가를 동반하였다. 또한, WTO TFA의 영향으로 인해 PTA의 주제와 언어 측면에서 이러한 조항의 수렴이 증가하고 있지만 상당한 차이점이 상존하고 있는 것 또한 피할 수 없는 사실이다. 기술의 발전은 무역 정보 포털, 단일 창구 시스템, 신고서의 사전 전자 처리 등 PTA의 무역 원활화 조항 설계에도 영향을 주었으며, 특히 관세 무역에 있어서 무역원활화의 중요요인으로서 이러한 역할은 지속될 것으로 예상되어진다. 현대 자유 무역 협정의 경우, 특혜 원산지 규정의 관리를 현대화하고 단순화하기 위한 다양한 발전이동시에 이루어지고 있다. 각국의 관세청이 자동화 개념을 더욱 잘 활용하고 위험 관리 및 통관 후 감사역량을 구축함에 따라 관세행정 비즈니스 프로세스는 고도화할 것이며, 관세 행정의 현대화는 관세 동맹, 특히 관세 및 세금 징수에도 영향을 미칠 가능성이 높으며, 프로세스, 신고 및 서류 요건이 더욱 단순화될것으로 분석되었다. 마지막으로, 체약 당사자가 PTA에 포함하는 무역 원활화 조항에 대한 궁극적인 테스트는 이행 범위의문제로 귀결되어지며, WTO 회원국은 합법적인 무역을 촉진하는 데 필요한 조치를 도입하려는 저개발국의 노력을 지원하는 데 중요한 역할을 할 수 있다는 데에 그 의의가 있다.
