이 글은 2022년 12월부터 2023년 11월까지의 대법원 판결 중에서 형법 분야의 중요 판결을 소개하고 분석한 글이다. 형법 총칙과 관련된 판결 중에서는 형법 제1조 제2항의 적용범위에 대한 판결과 정당방위에서 ‘침해의 현재성’에 대한 판결, 그리고 공동정범에 관한 판결들을 검토하였으며, 이른바 위법성조각사유의 전제사실에 대한 착오가 문제된 판결도 소개하였다. 형법 각칙의 영역에서는 사회적 관심의 대상이 되었던 강제추행죄에 대한 전원합의체 판결을 검토하였고, 인터넷 공간에서의 모욕 행위에 대한 판결 두 가지를 분석하였다. 그리고 배임죄에서 ‘타인의 사무를 처리하는 자’의 인정 범위를 제한하는 대법원 판례의 경향을 다시 확인한 전원합의체 판결을 소개하였다. 끝으로 형사특별법의 영역에서 비교적 최근에 제정되고 시행된 스토킹처벌법에 대한 대법원의 해석이 담긴 판례들을 소개하고 이를 분석하였다. 형법 제1조 제2항의 적용범위와 관련하여 대법원이 동기설을 포기 또는 폐기한 것은 늦은 감이 있지만 환영할 만한 일이다. 다만 대법원이 형법 제1조 제2항의 적용에서 여전히 예외를 인정한 것은 죄형법정주의의 실질적 의미를 고려할 때 유감스러운 일이다. 정당방위의 요건인 침해의 현재성과 관련하여 지속적인 침해상황에 대해 침해의 현재성을 법리적으로 인정한 것도 긍정적으로 평가된다. 강제추행죄에서 폭행·협박의 정도를 완화해서 평가하는 것은 변화된 현실과 그동안의 실무를 반영한 것이라 할 수 있다. 모욕죄에 대한 판결들은 모욕적 표현과 혐오 표현을 규제할 수 있는 효율적인 법체계를 고민하게 한다. 끝으로 시행된 지 얼마 되지 않은 스토킹처벌법에 관련된 판결들은 미완성으로 평가되는 스토킹처벌법의 해석에 대해 기본적인 방향을 제시하고 있다.
This article introduces and analyzes important rulings in the field of criminal law among Supreme Court rulings from December 2022 to November 2023. Among the judgments related to the general rules of the criminal law, the judgment on the scope of application of Article 1, Paragraph 2 of the criminal law, the judgment on the “presentness of infringement” in self-defense, and the judgment on joint crimes were reviewed. It also introduced a judgment on so-called ‘the error of the justification situation’. Among the rulings related to particulars of criminal law, the en banc decision on forced harassment, which was the subject of social interest, was reviewed, and two judgments on insults in the Internet space were analyzed. In addition, it introduced the ruling of the en banc, which reaffirmed the tendency of the Supreme Court precedent to limit the scope of recognition of “a person who handles other people’s affairs” in breach of trust. Finally, the precedents containing the Supreme Court’s interpretation of the stalking punishment law, which was enacted and implemented relatively recently in the realm of the Special Criminal Law, were introduced and analyzed.
