이 글은 2023년 한 해 동안 대법원이 다룬 민사(민법총칙 및 물권법 영역)판결 중 필자가 임의로 선정한 주요 판례 8개를 대상으로 하여, 그 판결을 소개하고 의미를 분석해 본 것이다. 권리남용, 성공사례금 채권의 소멸시효 기산점, 점유보호청구권, 과소 대지지분권을 가진 구분소유자, 공유물분할 방법, 유치권의 피담보채권, 유치권소멸청구, 저당물의 제3취득자가 갖는 비용상환청구권에 관한 판결을 소개하고 간단한 평석 내지 해설을 함으로써 그 판결의 의미를 살펴보았다.
This article is analytic review on 8 rulings from judgments on civil cases (General Provisions of the Civil Code and Property Law) handled by the Supreme Court during 2023, which the randomly selected. The writer analyzed and criticized some important cases on various subjects including abuse of rights, extinctive prescription, right to claim protection of possession, the divided ownership, right to demand partition of co ownership, lien, mortgage.
