텔레그램은 익명성을 최대한 보장하는 메신저이기에 그 효용이 매우 크지만 반대로 그 익명성에 따른 부작용도 만만치 않은 상황이다. 그러한 부작용에 대응하는 여러 나라의 노력은 다양하게 이루어졌다. 독일의 경우 소셜네트워크법(Netzwerkdurchsetzungsgesetz)으로 그러한 부작용을 사전 차단하려 하였지만, 과연 그 법의 적용 영역과 기준을 고려하면 어느 정도 효과가 있을지 불분명한 상태다. 브라질의 경우 텔레그램 앱(App) 자체를 차단하려는 사법부의 명령이 2회에 걸쳐 있었으나 과연 법원이 원하는 결과물이 나왔는지 역시 불분명하다. 인도에서도 텔레그램 관련 사건에서 법원이 이용자 정보를 공개할 것을 요구하였는데, 이 부분은 관할 문제를 초월하여 그 성과가 있었다. 한국도 n번방 사건의 무료회원에 대한 수사는 난관에 봉착한 것으로 판단된다. 이러한 텔레그램을 어떻게든 규제할 필요성은 당연하게 인정되는데, 과연 어느 정도의 규제가 적절하고 가능할 것인가에 대한 논의가 먼저 정리되어야 한다. 메신저 기능 자체를 차단하여야 할 것인지 아니면 중한 범죄의 경우에 한정하여 이용자들의 개인 정보를 수사기관에 제공하게 강제할 것인지는 규제의 정도에 해당하지만, 정작 그러한 규제가 가능할 것인가에 대한 것은 단순한 기술적 문제를 넘어, 사회적인 접근이 필요한 것으로 여겨진다. 텔레그램 자체의 차단이 끝이 아니고, 바로 다른 텔레그램 대체 수단의 등장으로 연결된다면, 익명성을 보장받는 사람들의 교류 그 자체라는 것이 과연 보장되어야 하는가에 대한 논의로 연결될 것이라고 할 것이다.
Telegram is a messenger that guarantees maximum anonymity. Although it has great utility, it also has its fair share of side effects. Many countries have made various efforts to eliminate such side effects. In Germany, Social Network Act (Netzwerkdurchsetzungsgesetz) was made but it is unclear to what extent it will be effective considering it's applicable area and standards. In Brazil, two court orders were issued to block the Telegram app, but it is unclear whether the desired result was achieved. In India, the court requested disclosure of user information in a Telegram-related case with success. In Korea, the investigation into the free members of the Nth room incident is believed to have encountered difficulties. The need to regulate Telegram could be justified, but the discussion about the justifiable regulation must first be resolved. Whether the messenger program & app should be blocked or messenger company forced to disclose users' personal information to a court is a matter of regulation, but whether such regulation is actually possible and justifiable does not remain merely as a technical issue. Furthermore a social approach is considered necessary to solve the real but hidden problem. If the blocking of Telegram is not the end and leads to other Telegram Apps, it will lead to a discussion about weather the anonymity should & could be guaranteed at all.
