신림역 흉기난동 사건으로 촉발된 일련의 무차별적 강력사건과 살인 예고가 속출하면서 한때 묻지마 범죄에 대한 시민들의 공포가 극에 달했다. 그러나 주요 치안이슈로 급부상한 묻지마 범죄에대해 관련 기관과 학계는 적절한 기능을 수행하지 못하는 실정이다. 해당 범죄의 특징이 충분히 규명되지 않은 것은 물론, 학술적 개념화와 통계적인 집계조차 되지 않고 있다. 잇따른 묻지마 범죄 이후 국무총리가 담화문을 발표하여 이상동기 범죄로 용어가 통일되는 분위기지만, 여전히 근거가 빈약하여 용어의 정의(定義)적 기능을 제대로 수행하지 못하고 있다. 본 연구에서는 ‘묻지마 범죄’ 용어의 대안으로 이상 범죄와 이상동기 범죄라는 위계적 분류체계및 판단기준을 제안하였다. 그리고 범죄통계자료를 분석하여 통계적 접근 방식의 가능성을 검토한다음 이상동기 범죄의 통계적 관리방안을 제안하였다. 그 핵심은 후보사건의 인지, 범죄분석관의 질적 평가, 전문가 집단에 의한 심의라는 3단계 평가체계에 있다. 추가적으로 이상동기 범죄에서 자기조절 개념의 중요성과 이상동기 범죄의 사회적 관리방안에 관해 논의하였다.
As a series of violent incidents and murders were announced, sparked by the Sillim Station stabbing incident, citizens’ fear of random crimes reached its peak. However, related organizations and academia are unable to properly perform their functions regarding abnormal crimes, which are rapidly emerging as a major public security issue. Not only has the characteristics of the crime in question not been sufficiently identified, but it has not even been academically conceptualized or statistically compiled. With the recent announcement of the Prime Minister’s statement, there is an atmosphere in which the terminology is being unified as abnormally motivated crime, but the basis is still weak and the definitional function of the concept is not properly performed. In this study, the reason for using abnormal motive crime as an alternative to the term ‘crime without question’ was revealed, and then the definition of abnormal motive crime (proposing abnormal crime as a higher-level concept) and judgment criteria were proposed. And based on the results of analyzing crime statistical data and examining the possibility of statistical approaches, a statistical management plan for abnormally motivated crimes was proposed. The core lies in the three-stage evaluation system: awareness of candidate incidents, qualitative assessment by crime analysts, and deliberation by an expert group. Additionally, the importance of the concept of self-regulation in abnormally motivated crimes and social management measures for abnormally motivated crimes were discussed.
