21세기에 접어들었음에도 일제강점기, 민주화운동 등 과거사를 둘러싼 논쟁이 주기적으로 사회적인 갈등요인이 되고 있다. 과거청산이 제대로 이루어지지 못했기 때문이며 이는 현재에 와서도 사회통합을 저해하는 부정적인 영향을 미치고 있다. 남북통일에 있어서도 본격적인 통일국면에 진입하면 북한정권의 반인권적 주민탄압과 부역자들의 범죄행위를 둘러싸고 이를 어떻게 처벌하여 과거청산을 이루어낼 것인지에 대한 논의가 활발해질 것이다. 따라서 본 연구는 남북통일 후 과거청산 문제에 대하여 특히 경찰의 역할을 중심으로 제도적 개선방안을 제시하고자 한다. 구체적으로 통일을 완수한 독일을 참고하여 서독이 동독의 국경지대 민간인 사살, 비밀경찰 운영 등 인권탄압 행위에 대한 과거청산을 위해 어떤 조치를 취했고 이 과정에서 경찰의 역할은 무엇이었는지에 집중하여 조망할 것이다. 이후 그 시사점을 남북통일의 사례에 적용하되, 검경 수사권 조정과 자치경찰제도 도입 등 한국 경찰의 변화를 반영하여 실현가능한 정책적 제언을 함께 제시하고자 한다. 본 연구는 아직 국내에 충분히 무르익지 않은 통일 후 과거청산 문제를 어떻게 접근하여야 하고 특히 경찰의 역할은 무엇인지에 집중하여 종합적으로 고찰하였다는 점에서 그 의의가 있다.
Even if 21 century already started, clearing the past of the japanese colonial period, Korean War, democratization movement during military regime is always a major issue which spark social controversy in korean society. This is largely due to the fact that the past was not properly resolved, and because of this, social integration is hardly achieved even in modern times. And if Korean peninsula entered into unification process, a lot of argument would erupt on clearing the past about how to punish the North Korean regime’s oppression of residents. So main purpose of this study is to introduce insititutional improvement plan on clearing the past issue, especially focusing on the role of the police. Referring to the example of Germany, where unification was achieved, how the West Germany (then) took action to solve the issue such as killing civilians in East Germany’s border areas and operating secret police stasi, focusing on the role of the police also. Next, applying the implications to the case of Korea, we would like to present policy suggestions that can be implemented in practice by reflecting the changes in the Korean police, where the adjustment of powers between prosecution and police has progressed and the autonomous police system has been adopted. This study is significant in that it comprehensively examined the issue of clearing up the past after unification, which has not yet been sufficiendtly discussed in korea, by focusing on the role of the police.
