최근 제4차 산업혁명의 도래로 말미암는 융합기술의 등장은 여러 다양한 장비와 장치를 등장시키고 있는데 그 중 대표적인 것이 자율자동차이다. 혁신적인 기술로 부상하고 있는 자율주행 자동차는 실제로 여러 복합적인 기술의 적용으로 인하여 사회의 관심을 본격적으로 받고 있다. 특히 자율주행자동차는 인공지능 기술의 발전과 더불어 그 논의가 본격화되었다는 점에서 자율주행자동차의 개발과 운행에 있어 인공지능과 관련한 다양하고 심도 있는 논의 역시 매우 중요하다고 볼 수 있다. 인공지능으로 인하여 자율주행 자동차는 이전의 통상적인 자동차보다 보다 높은 수준의 주행 능력을 구비할 수 있게 되었기 때문이다. 더욱이 자율주행자동차의 운행으로 말미암아 적지 않은 사회・경제적 실익을 확보할 수 있을 것인데, 즉 이를 통하여 교통안전성을 제고할 수 있을 것이고 안전하고 원활한 교통을 위한 도로 건설, 관련 도로관리체계의 개선 역시 유인할 수 있을 것으로 기대되고 있다. 뿐만 아니라 이산화탄소 경감과 같은 환경보호 및 에너지 소비 효율화 그리고 장애인과 노인 등을 위한 실제적인 이동 수단의 제공 가능성 역시 제고하고 있는 것 역시 자율주행자동차 도입에 대한 적극적인 입장을 고집하도록 하는 사항이기도 하다. 하지만 자율주행자동차 도입에 청사진만 제시할 수 있는 것은 아닌데 가장 큰 고민은 자율자동차로 인한 사고에 대한 책임 부여의 문제이다. 책임은 인간의 존엄성과 법치국가원칙에 근거한 헌법상의 원칙으로서 행복추구권으로부터 유래하는 중요한 기본권으로 상정되고 있다. 특히 특정인에게 책임을 부담시키기 위해서는 사고 발생에 대한 원인과 결과 사이에 인과관계가 인정되어야 하며 특히 그 행위자에게는 과실이 인정되어야 한다. 그런데 자율주행 자동차, 완전주행단계의 자율주행자동차로 인하여 사고가 발생하는 경우, 그 자동차의 탑승자는 운전과 조작을 하지 않는다는 점에서 과연 누구에게 책임을 부담시킬 수 있을 지가 문제이다. 그런데 이와 관련 스웨덴에서는 Vision Zero를 중심으로 책임에 대한 다각적인 논의가 전개되고 있다. 특히 스웨덴에서의 논의의 방향은 자율주행자동차에 탑재되는 인공지능은 일반적으로 논의되고 있는 강한 인공지능이라기보다는 고도의 기술이 내장된 소프트웨어라는 사항을 향하고 있다. 자율주행자동차 사고로 인한 책임 관련 백가쟁명식의 논의가 펼쳐지고 있는 현 우리의 상황에서도 고려할 수 있는 사항이라고 생각된다.
The recent emergence of cutting-edge technology with the advent of the 4th Industrial Revolution is introducing a variety of equipment and devices, and particularly the representative of which is Self-driving Cars, namely autonomous vehicles. Self-driving cars, which are emerging as one of the innovative technologies, are actually attracting the attention of society in earnest due to the application of complex technologies. In particular, due to the rapid development and brand new operation of self-driving cars based on the artificial intelligence technology, various and in-depth discussions related to artificial intelligence are becoming more important. This is because self-driving cars itself now have a chance to be given a higher level of driving ability than conventional cars due to artificial intelligence. Moreover, it will be possible to secure considerable social and economic benefits or interests through the operation of self-driving cars, that is, it is expected that traffic safety will be improved through this cars, and moreover road construction for safe, smooth traffic condition and improvement of related road management systems may be induced as well. In addition, environmental protection, energy consumption efficiency, such as carbon dioxide reduction, and the possibility of providing practical means of transportation for the challenged and the elderly are also secured makes us insist on an active position on the introduction of autonomous vehicles in our society. However, there is only blue print for the introduction of autonomous vehicles, due to the fact that there is the biggest concern or issue of assigning responsibility for accidents caused by autonomous vehicles. Responsibility is a constitutional principle based on human dignity and the rule of law, and is considered to be an important issue for the protection of fundamental right derived from the right to pursue happiness. In particular, in order to bear responsibility for a specific person, a causal relationship must be admitted between the cause and effect of an accident, and in particular, negligence must be recognized for the actor. However, in the event of an accident due to an self-driving cars in the full self-driving(FSD) stage, the occupant of the vehicle does not drive and manipulate, so it is a question that who can be held responsible. In this regard, various discussions on the responsibility issues are being developed in Sweden, concerning with ｢Vision Zero｣. In particular, the focus on the discussion related to the accident caused by a self-driving car in Sweden is toward the fact that artificial intelligence installed in autonomous vehicles is not the strong artificial intelligence that is generally discussed, but rather the software embedded with high technology. This is to be considered as a important matter in discussing on the responsibility of a self-driving car or others in our country where there is a great deal of disputes over the issue.
