생성 AI의 학습에는 저작물을 포함하는 대량의 학습데이터를 사용하게 되는데, 학습과정에서 저작권 침해 여부에 대한 이슈가 있다. 우리 저작권법은 공정이용에 관한 규정을 두고 있지만 예측가능성 측면에서 한계가 있으므로, 저작권 학계, 정부 및 국회 차원에서도 지난 수년간 TDM 관련 저작권법 개정에 관한 논의를 이어오고 있다. 이 글에서는 최근 이슈가 되고 있는 대표적인 생성 AI 및 학습데이터 사례들을 통해, 생성 AI가 원 저작물 또는 데이터 관련 시장에 어떠한 영향을 미치는가를 고려하면서, 현재 국회에 계류되어 있는 3개의 TDM 관련 개정안을 검토한 후 그 문제점을 분석하였다. 이러한 분석 내용을 토대로 TDM 관련 저작권법 개정 방향에 대해 3개의 옵션을 제시하였다. 옵션 1.은 기본적으로 현행 공정이용 규정을 적용하되, AI 연구 및 산업계를 위한 가이드를 제공하는 방안이다. 옵션 2.는 연구기관 등의 비영리적 이용에 대해서는 TDM 면책 규정을 도입하고, 영리적 이용에 대해서는 공정이용 조항을 적용하도록 하는 것이다. 옵션 3.은 영리적 이용의 범위까지 적용되는 TDM 면책 조항을 도입하는 방향이다. 방향 설정에 앞서 생성 AI와 그 대상이 되는 저작물 또는 데이터에 관한 국내 연구 현황 및 시장 상황 등에 대한 면밀한 조사·분석이 선행되어야 하며, 이를 바탕으로 구체적인 방향을 설정하는 것이 바람직하다.
In the training of generative AI, a large amount of training data, including copyrighted material, is often used, raising concerns about copyright infringement during the learning process. While our copyright law has the provision for fair use, There is an issue of low predictability. As a result, discussions regarding revisions to copyright laws related to Text and Data Mining (TDM) have been ongoing in academia, government, and the legislature over the past few years. This article examines recent issues surrounding prominent generative AI and training data cases and analyzes the impact of generative AI on the original content and data-related markets. It then reviews three TDM-related amendment proposals currently pending in the legislature, highlighting their shortcomings. Based on this analysis, three options are proposed for the direction of TDM-related copyright law revisions: Option 1: Essentially maintains the current fair use provision but provides guidelines for AI research and industry. Option 2: Introduces a TDM exemption clause for non-profit entities, such as research institutions, while applying fair use provisions to commercial use. Option 3: Introduces a TDM exemption clause extending to commercial use cases. Before determining the direction, a thorough investigation and analysis of domestic research trends, market conditions related to generative AI and the materials or data it operates on, should be conducted. It is advisable to base the specific direction on this comprehensive research and analysis.
