가족관계등록제도란 우리나라 국민의 출생․입양․혼인․사망 등 가족관계의 발생 및 변동에 관한 사항을 「가족관계의 등록 등에 관한 법률」(이하 ‘가족관계등록법’이라 함) 등에서 정한 절차에 따라 가족관계등록부라는 공부에 등록하고 이를 공시하는 제도이다. 가족관계등록부가 실질적인 가족관계와 다르게 잘못 기재될 수 있으며, 이 경우 가족관계등록부는 그 공시적 기능을 제대로 수행할 수 없을 것이므로 이를 정정해야 한다. 원칙적으로 이러한 정정은 가족관계등록법에서 규정한 절차에 따르고 있다. 그런데 이러한 정정 이외에도 특별법에 따라 가족관계등록부를 작성하거나 정정하는 경우가 있다. 본고에서는 이러한 특별법 중에서도 특히 「제주 4․3사건 진상규명 및 희생자 명예회복에 관한 특별법」 제12조에 정한 절차를 중심으로 특별법에 의한 가족관계 정정절차에 대하여 살펴보고자 한다. 특별법에 따라 가족관계등록부를 정정할 경우, 그 문언에도 불구하고 모든 기재사항에 대하여 위원회의 결정만으로 등록부 정정이 가능하다고 볼 수는 없다. 왜냐하면 위 12조는 문언적 해석만으로는 충분히 그 의미를 파악할 수 없으므로 기존의 가족관계등록법상 정정 절차와 법체계적 해석에 의하여 의미를 규명하여야 하며, 그에 의할 때 기존의 가족관계등록법이 예정하고 있는 정정 절차의 큰 틀에 부합하여야 한다는 결론을 얻을 수 있기 때문이다. 이러한 법체계적 해석론에 따라 제주 4․3사건 위원회는 가족관계등록부 작성 등 대상자에 대하여 실질적 가족관계와 가족관계등록부의 기재 사항이 다른 모든 경우에 대해 심의하고 의결할 것이 아니라 제한적인 범위 내에서만 이를 심의· 의결할 권한이 있다고 보아야 한다. 특히 가족관계등록법 제107조의 사안에 대해서 심의· 의결하는 것은 법원의 판결에 의해서만 가능하며, 위원회 권한 밖의 일이다.
The Family Relations Register system is to register matters related to occurrence and changes in family relations, such as birth, adoption, marriage, and death according to the procedures stipulated in the 「Act on Registration of Family Relations」. And it is a system that records in a reliable register for the public to see and trust it. The Family Relation Register may be misrepresented when it is different from the actual family relation. Then the Family Relation Register will not be able to properly perform its public functions, so it must be corrected. In principle, these corrections follow the procedures stipulated in the 「Act on Registration of Family Relations」. However, in addition to these procedures, there are cases in which the Family Relation Register is corrected according to some special laws. In this paper, among these special laws, I would like to focus on the procedures stipulated in Article 12 of 「Special Act Discovering the Truth on the Jeju 4․3 Incident and the Restoration of Honor of Victims」(Hereinafter, it is referred to as 'the Jeju 4․3 incident act'). The Jeju 4․3 Incident Committee cannot decide whether or not to correct all cases in which the Family Relation Register was incorrectly recorded. This is because, even if the correction of the Family Relation Register is allowed according to the Jeju 4․3 incident act, which is different from the existing procedure, it should legally and systematically conform to the Family Relation Registration process. The Jeju 4․3 Incident Committee should consider that it can decide within a limited scope, especially when the Register is to be rectified according to a final and conclusive court decision.
