검·경수사권으로 경찰 수사부서의 업무량이 폭증함에 따라 수사경찰의 근무환경 악화되어 수사경찰은 수사부서 근무를 기피하고, 동시에 수사전문성 약화와 고소인 등 사건관계자들의 수사결과에 대한 불만족으로 나타나고 있다. 그러나, 의경제도 폐지 등 다양한 이유로 폭증한 업무량에 비례하여 수사경찰을 증원하는 것이 현실적으로 불가능한 상황이라면 이에 대한 해법으로 해외와 같이 탐정과의 협업이 제시될 수 있으며, 지난 18년간 탐정기본법이 통과되지 못한 상태임에도 2020년 8월 「신용정보 및 보호에 관한 법률」 일부 개정으로 인해 관리·감독이 부재한 상태에서 탐정업이 활성화되고 있는 추세이다. 공공영역에서의 아웃소싱(Out-sourcing)이란 외부의 전문회사를 활용하여 조직활동의 일부를 수행하게 한 후 이를 통해 조직의 핵심역량을 강화하여 조직운영의 효율성·전문성을 확보하는 일련의 활동으로서 과거 경찰은 업무특성상 아웃소싱을 통한 민간과의 협업에 소극적인 입장을 취해왔으며 관련 연구도 미비한 편이다. 본 연구는 경찰수사업무 중 공인탐정으로 아웃소싱이 가능한 업무영역은 무엇이며, 이를 위해 법적·정책적으로 고려해야 할 사항은 무엇인지, 아웃소싱 이후에 경찰수사에 미칠 수 있는 위협적 요소와 이를 예방할 수 있는 조치는 무엇인지를 밝혀내는 것을 주된 목적으로 한다. 이를 위해 업무적 유사성 등을 감안하여 수사·조사업무 전문가 집단인 수사경찰을 상대로 인터뷰를 통해 자료수집·분석한 후 타당성 확보 차 설문조사를 병행하였다. 연구결과상 수사경찰은 총 48개 항목에 대한 평균 타당성(긍정응답률)은 83.1%이고, 표준오차(SD)가 1.03으로 일반적 연구기준에 부합하는 것으로 나타났다. 이를 통해 수사경찰은 아웃소싱을 통한 선택적 집중을 통해 직무만족도와 수사역량을 높이고, 동시에 공인탐정은 도입취지 및 전문성을 발휘할 수 있는 업무영역을 확보에 일조할 수 있을 것으로 기대한다.

Due to the prosecution and police investigation authority, the workload of the Police Investigation Department is increasing. This huge workload of the Police Investigation Department makes the investigative police feel too tough. And it results in police officers' avoiding working in the Investigation Department, lack of expertise on investigations, and dissatisfaction with investigation results. And also, practically it is impossible to increase the number of the investigative police because of various reasons such as the abolition of the conscripted police system. Therefore, here, like other countries, collaboration with detectives can be suggested as a solution to these problems. And the detective industry is being activated in absence of manage and oversee by starting some revisions of <the Credit Information and Protection Act> in 2020, even though the Detective Act has not been passed for the past 18 years. Out-sourcing in the public sector is defined as a series of activities of using external specialized companies in public service areas, and it gives advantages of the efficiency and expertise to the department by strengthening the core capabilities of the organization. In the past, the police took a passive position in collaboration with the private sector through outsourcing due to the nature of their work, and also there is insufficient research on this matter. Therefore, the main purpose of this study is to find out what areas of work can be outsourced to authorized detectives, legal and policy preparations to be considered, and what threats to police investigations after outsourcing and ways to prevent them. To do this study, I collect and analyze the results from interviews with the investigative polie who is an expert in investigation, then I also conduct surveys for a validity, and which leads to an integrated study. As a result of the study, the validity of total 48 questions about necessity of collaboration with detectives (positive response rate) is 83.1%, and the standard error(SD) is 1.03. Through the results of this study, it is expected that the investigative police would obtain the satisfaction about their works and the investigatve capabilities through the selective concentration of their works by using outsourcing, and authorized detectives could make a synergy effect and help to keep a social safety based on their specialty.
