범죄를 효과적으로 예방하여 안전한 사회를 구축하기 위해서 시민의 자발적인 법 준수는 중요한 영역으로 인식되고 있다. 따라서 준법의식에 대한 연구가 꾸준히 진행되고 있지만 대부분 특정 계층을 대상으로 연구를 수행하였으며 사회구조적 특성만을 다루고 있다. 이에 본 연구는 한국법제연구원의 2021년 국민법의식조사 자료를 활용하여 준법의식에 영향을 미치는 요인을 개인적요인과 사회·구조적 요인으로 나누어 살펴보았다. 연구 결과 절차적 공정성 인식이 준법의식에 긍정적인 영향을 미치는 것으로 나타났으며, 개인이 인식하는 경제적 수준은 준법의식에 부정적인 영향을 미쳤다. 또한 준법교육을 받은 개인일수록 준법의식이 높은 것으로 나타났다. 그러나 교육 수준이 높거나 대도시에 거주하는 사람일수록 준법의식이 낮은 것으로 분석되었다. 분석결과를 바탕으로 준법의식 향상을 위한 방안을 제시하였다.
This study investigates the determinants that influence awareness of legal compliance based on data obtained from the 2021 National Legal Awareness Survey conducted by the Korea Legislation Research Institute. The findings indicate that the perception of procedural fairness positively impacts awareness of legal compliance. Conversely, individual’s perceived economic level negatively affects their awareness of legal compliance. Furthermore, the study reveals a positive relationship between education about legal compliance and higher levels of awareness of legal compliance. However, individuals with higher levels of education or residing in large cities exhibit lower levels of awareness of legal compliance. Based on the reuslts of this study, we suggested various policy implications to elevate awareness of legal compliance.
