한국에 체류하는 중국인 유학생의 생활과 행동을 다룬 수많은 연구가 있었음에도, 우리는 유학생들이 맺는 계약에 어떤 관계적 성격이 내재해 있는지 알고 있지 않다. 당사자 간 불확실성의 감소와 관계의 확인이라는 목적을 가진 사회적 행위가 계약이라는 이론적 전제 위에서, 이 글은 재한 중국인 유학생들의 모바일 계약과 주택임대차 계약에 내재한 관계적 성격이 중국인과 한국인을 대상으로 했을 때 달리 나타남을 규명한다. 이질적 집단과 맺는 관계에서는 불확실성을 감소하려는 도구적 유용성이, 동질적 집단과 맺는 관계에서는 관계의 확인이라는 정서적 해석이 주로 개입한다는 가설하에서, 3년 이상 체류한 25명의 중국인 유학생들이 중국인 혹은 한국인과 맺었던 계약의 경험을 심층 면접을 통해 해석하려 했다. 유학생들은 한국인과의 계약 관계에서는 도구적 합리성과 전문성을 중시했지만, 중국인과의 계약 관계에서는 외국에 사는 동족 집단에 대한 정서적 공유를 기대했고 계약에 만족하지 못하는 경우 실망하고 불신했다. 계약 당사자가 중국인인가 한국인인가에 따라 중국인 유학생들이 관계의 의미를 달리 해석한다는 이 연구는 유학생들이 맺는 사회적 관계의 다의적 측면과 계약이라는 법 현상에 사회적인 것이 작동하고 있다는 점을 보여준다
Even though many researchers have examined the lives and behaviors of Chinese international students in South Korea, few have studied what relational characteristics are involved in the contracts signed by these international students. Theorizing contracts as a social act of reducing uncertainty and confirming relationships, we investigate the relational characteristics involved in the Chinese students’ mobile phone contract and housing lease contract. Under the hypothesis that the instrumentality works mainly in contracts with Koreans while the emotional interpretation is primarily involved with Chinese, we interviewed 25 Chinese students who have stayed for more than three years. While the Chinese students tended to value instrumental rationality and expertise with Koreans, they interpreted normatively the contracts with Chinese by showing disappointment and distrust to cases in which they believed the contract was poorly signed or executed by Chinese brokers and parties.
