본 연구는 최근 인공지능 시스템의 기술 발달로 인공지능에 의한 창작물이 많이 생산되는 상황에서 이를 저작권법적으로 어떻게 해석하고 적용할 것인가를 다루는 내용이다. 현재 우리 저작권법 제2조 제1항은 ‘저작물은 인간의 사상 또는 감정을 표현한 창작물을 말한다.’라고 규정하고 있다. 여기서 인공지능 시스템이 창작한 창작물이 우리 저작권법으로 보호되는 저작물에 해당되느냐가 문제될 수 있다. 왜냐하면 우리 저작권법은 ‘인간’의 사상 또는 감정을 표현한 창작물을 저작물로 규정하여 저작물을 창작할 수 있는 주체를 ‘인간’으로 한정하고 있기 때문이다. 또 저작권법상 보호받을 수 있는 저작물로 인정되더라도 저작자가 누가 되며, 저작권은 누구에게 귀속되는가는 별개의 문제가 될 수 있다. 한편 인공지능 시스템의 창작물이 타인의 저작물을 침해했을 때의 저작권침해와, 반대로 타인의 저작물이 인공지능 시스템의 창작물을 침해했을 때의 저작권침해와 관련해서 저작권침해 요건이나 또 인공지능 시스템이 활용한 빅데이터 활용과 관련해서 데이터마이닝 그리고 공정이용의 법리 적용이나 보호기간과 같은 부분도 새롭게 검토를 해 보아야 할 영역이다. 그 외에도 인공지능 시스템의 창작물을 보호하는 형태와 관련해서 저작권법적으로 보호할 것인지 아니면 별도의 독자적 법률을 만들어서 보호를 할 것인지 등의 문제도 저작권법의 해석과 관련해서 재조명해볼 필요성이 제기된다. 따라서 이 글은 우리 저작권법의 해석상 이러한 내용들을 연구, 검토하고 향후 저작권법의 개정과 관련해서 입법론적인 대안들을 논의하는데 그 의미가 있다고 하겠다.
This study is composed of contents to investigate various problems and issues that appear legally and systematically in protecting creations of artificial intelligence system with copyright, and to examine the solutions First of all, in relation to the protection of artificial intelligence system creations, the legislation and precedents of the WIPO, the United States, Japan, the United Kingdom, and China were examined. The following are the main issues, which are the most problematic issues in protecting creations of artificial intelligence systems with copyrights: 1.The issue of whether or not the literary work is recognized for creations of artificial intelligence systems; 2.The author's status in the artificial intelligence system and the issue of copyright attribution; 3.The problem of copyright infringement by the artificial intelligence system was reviewed. Other issues include copyright infringement on the creations of the artificial intelligence system, the protection period for the creations of the artificial intelligence system. Also, the question of how to protect creations of artificial intelligence systems by independent laws rather than copyright laws, was also briefly examined. In addition, in protecting the creation of artificial intelligence systems, we will look at the process of reforming the laws and systems of the Korean government.
