복합운송이란 2종류 이상의 운송수단에 의하여 실행되는 운송을 의미한다. 복합운송은 컨테이너의 개발과 함께 급속히 증가되어 최근에는 각종 운송의 상당 부분이 복합운송으로 이루어지고 있다. 이러한 복합운송에 대한 각종 규율을 위해 여러 차례 상법 개정안이 제안되었으나, 실제로 상법 개정에 이르지 못한 채 현재에 이르고 있다. 본 글에서는 그간 복합운송과 관련하여 문제점으로 지적된 쟁점들에 대해서 검토하고, 종래 복합운송규정 개정안의 긍정적 측면을 검토하여 빠른 상법 개정 촉구를 제안하고자 한다.
Multimodal transport means transport carried out by two or more types of transport. Multimodal transportation has rapidly increased with the development of containers, and recently, a significant part of various transportation has been performed by multimodal transportation. Several amendments to the commercial law have been proposed to regulate various types of multimodal transportation, but they have not been actually amended until now. In this article, I would like to review the issues that have been pointed out as problems in relation to multimodal transportation, and review the positive aspects of the existing multimodal transportation regulation amendment bill to propose a quick revision of the commercial law.
