본 연구는 포장용기의 품목분류 원칙 규정인 국문본 관세율표 통칙 제5호에 대해 일부 번역과 해석방법에서 오류 주장이 제기되고 있어, 관련 주장을 알아보고 통칙 제5호의 정확한 해석방법을 찾는데 그 목적을 두고 있으며, 연구의 방법으로 HS 통칙의 역사·환경을 바탕으로, 포장용기에 대한 관세당국의 분류관행과 통칙 제5호 해석 관련 선행 논문을 앞서 살펴보고, HS 통칙 제5호 원문의 전문기관 번역을 바탕으로 신번역문을 작성하고 국문본을 비교분석 하였다. 전문기관 번역을 바탕으로 작성한 통칙 제5호 신번역문에 의해 국문본을 비교 분석한 결과, 통칙 제5호가목 조항은, 국제무역에서 “물품과 함께 정상적으로 판매(매매)된 종류”의 경우에서, 일체분류기준 충족 용기에 대하여, 개별분류가 아닌, 물품 일체적 종속 분류토록 특례 하여, 기준 미달의 경우에는 당연히개별분류 법리가 적용되는 것이고, 종속조항 나목은 가목의 카테고리인 “정상적 판매종류”를 제외, 물품동일체적 취급 포장인 “정상적 사용 종류”에 대하여 개별분류 없이 물품 일체적 종속분류토록 그 분류를 지배(govern)하고 있음을 알게 된 것으로서, 본 연구는 포장용기 분류에 대한 이러한 국문본 통칙 제5 호의 올바른 해석방법을 찾아 향후의 개정 방안을 제시하는 데 그 목적을 두었다.
While claims had been raised that there were errors in some translations and interpretation methods for the Korean version of General Rule No. 5 of the Tariff Schedule, a regulation on the principle of the item classification of packing containers, this study aimed to find out the claims and to understand accurate interpretation methods of the General Rule No. 5. Furthermore, it examined the customs authority' classification practices for packing containers and previous papers regarding the interpretation of the General Rule No. 5 based on the history and environment of General Rules for the HS by means of research, and it made a comparative analysis on the original text of the General Rule No. 5 for the HS newly translated by a specialized organization with its Korean version in order to verify the claims about errors in the Korean version being raised. As a result of the comparative analysis on the new translation of the General Rule No. 5 by a specialized organization with its Korean version, for Item (a) of the General Rule No. 5 for the HS, in the case of the“normally sold varieties with goods”in international trade, packing containers that meet the specialization standards are subject to a special case of integral dependency classification, rather than to individual classification according to the principle, and thus packing containers that do not meet the applicable standards will, of course, have legal principles that are individually classified according to the principles. The dependent clause Item (b) excludes the category of Item (a)“normally sold varieties”does not separately classify “normally used varieties”, packing containers that are treated as being integral to goods, while governing the classification in which the packing containers and their contents are subject to the application of integral dependency classification. The purpose of this study is to find the correct interpretation method of General Rule No. 5 of the Korean Language on the packing containers and to suggest future revisions.
