한국의 대통령제에서 정권은 5년 주기로 교체된다. 여야가 교체되는 경우는 물론이거니와, 집권여당의 교체가 없는 경우라도 대통령의 교체 자체만으로 국정과제 및 정책 등에 있어 적지 않은 변화가 수반된다. 법치주의 특히 법치행정의 원칙 하에서 이러한 변화는 관련 법령의 제・개정을 요구한다. 단순 산식으로 본다면, 5년 주기의 입법적인 큰 변화가 기본 값으로 설정되어 있는 것이다. 이 뿐만 아니라, 동일한 정권 내에서도 입법적 성과의 도출 또는 정책에 대한 입장 번복 등 다양한 이유로 입법적 변화가 빈번하게 발생하고 있다. 이처럼 다량의 신속한 입법이 요구되는 환경일수록 입법의 성급함을 경계(警戒)해야 한다. 성급한 입법의 폐단을 방지하기 위해서는 입법절차가 형식적으로 적법하게 진행되어야 한다. 또한, 해당 절차에서 내용적으로 그 취지에 맞는 숙의(熟議)가 보장되어야 한다. 실질적 법치주의는 입법절차에도 적용되는 것이며, 입법상 적법절차의 원칙이 실질적으로 완성되기 위해서는 절차진행의 내용을 이루는 숙의의 적정성까지 확보되어야하기 때문이다. 특히 법치주의 구현의 제도적 첫 단계에 해당하는 새로운 법률의 제정에 대해서는 이와 같은 요구가 더욱 엄격하게 준수되어야 한다. 그럼에도 행정법학의 분수령이라는 평가까지 받고 있는 행정기본법의 제정과정에 대해 절차적 문제가 제기되고 있다. 일부 연구에서는 상당히 강한 어조로 행정기본법 제정과정의 문제점을 지적하고 있는 실정이다. 반면, 행정기본법의 제정에 관해 오래 전부터 논의가 있어 왔다는 이력이나 행정기본법의 내용이 이미 행정절차법의 제정과정에서 다루어진 바 있다는 사정 등을 이유로 그 제정과정이 적절했다는 의견도 있다. 이에 본 연구는 행정법의 成文化로서 행정기본법의 제정이 지니는 입법적 의의와 지금까지 절차의 형식적 적법성에 비해 상대적으로 숙의의 적정성이 소외되어 온 현실을 접목해, 행정기본법 제정과정상 숙의의 적정성을 분석하였다. 세부적으로는 행정기본법 제정을 통한 행정법의 成文化 배경, 행정기본법 제정 과정에 대한 연구의 필요성 등을 먼저 살펴보았다. 이어서 행정기본법 제정의 추진경과를 살펴보고, 그에 대한 숙의의 적정성에 관한 문제를 제기하였다. 이를 기초로 행정기본법 제정과정을 정부에서의 성안과정(법률안 국회제출 단계까지)과 국회에서의 입법과정으로 나누고, 각각의 과정에서 숙의가 적정하였는지 여부를 분석하였다.
In an environment where a large amount of rapid legislation is required, we should be wary of the hastiness of legislation. In order to prevent hasty legislation, a legislative procedure must proceed legally. In addition, the deliberation must be done in accordance with the purpose of the relevant procedures. These are due to several factors, including: (1) Substantial constitutionalism also applies to a legislative procedure. (2) In order for the principle of due process to be fully realized in legislation, the appropriateness of deliberation must be guaranteed. In particular, the demands should be more strictly observed in the enactment of a new law, which is the first stage of the implementation of the rule of law. Nonetheless, many questions have been raised about the process of enacting the General Act on Public Administration, which is regarded as a watershed moment in administrative law. Some studies point out problems in the process of enacting the Act in a fairly strong tone. On the other hand, some emphasize that the process is appropriate. This opinion is based on the history of discussions on the Act's enactment as well as the fact that the contents of the Act were already reviewed in the enactment of the Administrative Procedures Act. This study analyzed the appropriateness of deliberation in the process of enacting the Act. It is considering the legislative significance of the enactment of the Act, and the reality that the appropriateness of deliberation has been relatively neglected compared with the legality of a legislative procedure. In studying the appropriateness of deliberation, this paper has divided the legislative procedures of the Act into a step in the government and the one in the National Assembly. Based on this, it investigates whether the deliberation in each step was appropriate.
