본 연구는 대상조항인 형법 제1조 제2항의 적용요건 중 ‘법률의 변경’의 뜻을 해석함을 목적으로 한다. 대상판결은 동기설에 입각한 종전의 태도를 폐기하면서, ‘변경’의 개념요소로서 형벌법규의 가벌성에 직접 관련되는 형사법적 관점의 변화를 새롭게 요구한다. 아울러 사안 해결을 위한 직접적인 쟁점이 되지 않은 방론들에 대해서까지 유형화하여 각각의 해결 법리를 제시한다. 형벌법규 자체(제1 유형)나 하위 법령(제2 유형)의 경우에는 당연히 형사법적 관점의 변화가 전제된 것으로 보면서 대상조항의 적용을 긍정한다. 다른 법령(제3 유형)이 변경된 경우에는 형사법적 관점이 변화된 것인지 따져보아 그 적용 여부를 결정하는 취지로 판시한다. 협의의 한시법(제4 유형)에서 예정된 유효기간이 경과하여 법령의 효력이 상실된 경우에는 변경으로 볼 수 없고 형사법적 관점의 변화도 전제되지 않았을 뿐만 아니라 추급효를 인정하는 것이 입법자의 의사에 부합한다는 3중(重)의 논거를 들며 대상조항의 적용을 부정한다. 하지만 ‘법률’과 ‘변경’ 모두 비교적 명백한 개념인 만큼 특별한 사정이 없는 한 문리적으로 해석함이 원칙이다. 법률은 국회에서 제정한 형식적 의미의 법률을 뜻하고, 변경은 사후적으로 기존의 것과 내용이 달라지는 것을 뜻한다. 이러한 문리적 해석에 따르면 제1 유형에는 대상조항이 직접 적용되고, 제2 유형에는 유추 적용되며, 제3 유형에는 직접 또는 유추 적용된다. 반면 제4 유형의 경우는 사전적으로 예정된 효력 상실에 불과할 뿐이므로 변경에 해당할 수 없어 대상조항이 적용될 수 없다. 대상판결의 태도와 비교해 보면 결론에 있어 차이가 나는 부분은 제3 유형뿐이다. 하지만 제3 유형에 대한 대상판결의 해결 법리는 목적론적 축소해석으로서 문언의 가능한 의미를 벗어날 뿐만 아니라 그 적용범위를 축소할 만한 불가피하고 합리적인 사정도 드러나지 않아 정당화되기 어려워 보인다. 대상판결은 제3 유형의 경우 형사법적 관점의 변화 유무에 따라 결론이 가변적일 수 있는 해결 법리를 도출하려다보니, 모든 유형을 공통적으로 설명할 수 있는 기능적 표지가 필요했었던 것으로 추정해 볼 수 있다. 이에 따르면 대상판결은 핵심표지를 새롭게 설정한 점보다는 오히려 각 유형별로 나름의 해결 법리를 제시한 점에서 그 실천적 의의를 찾을 수 있다. 특히 전형적인 제1, 2 유형에 대상조항이 당연히 적용되도록 한 점은 법적안정성의 확보 차원에서 종전 판례의 문제점을 상당 부분 극복한 큰 진전이라고 평가할 수 있겠다.
The purpose of this study is to interpret the meaning of the change in the law among the application requirements of Article 1(2) of the Criminal Act, which is the target clause. The subject judgment abolished the previous attitude based on the motive theory in relation to the concept of change. Instead, it demands a change in the criminal law perspective that is directly related to the criminality of penal laws. In addition, even matters that are not directly necessary for resolving the issue are categorized, and legal principles for solving each type are presented. In the case of the penal law itself (type 1) or subordinate regulations (type 2), the application of the target clause is affirmed, assuming that a change in the criminal law perspective is of course premised. If other laws or regulations (type 3) are changed, whether they apply or not depends on whether the criminal law perspective has changed. If the validity is lost due to the lapse of the period in laws or regulations with expiration date (type 4), it cannot be regarded as a change, and a change in the criminal law perspective is not premised. In addition, it is in accordance with the intention of the legislator to punish the act before it expires. Therefore, the application of the target clause is denied. However, as both law and change are relatively clear concepts, it is a rule to interpret them in a literal sense unless there are special circumstances. A law means a statute in a formal sense enacted by the National Assembly, and a change means becoming different in content from the existing one ex post facto. According to this literal interpretation, the target clause is directly applied to type 1, applied by analogy to type 2, and directly or analogically applied to type 3. On the other hand, in the case of type 4, the target clause cannot be applied because it is only a pre-planned loss of effect, and therefore cannot fall under change. Compared to the attitude of the subject judgment, the only difference in the conclusion is type 3. However, the legal solution to the subject judgment for type 3 is a teleological narrowing interpretation, which not only deviate from the possible meaning of the text, but also seems difficult to justify as there are no inevitable and reasonable circumstances to reduce the scope of application of the target clause. In the case of type 3, the subject judgment derives a legal solution with a variable conclusion depending on whether there is a change in the criminal law perspective. As a result, it can be assumed that a functional marker that can be common to all types was needed. According to this, it can be said that the subject judgment has practical significance in that it presents its own legal solution for each type related to the scope of application of the target clause, rather than newly establishing an abstract key mark. In particular, the fact that the target clause is naturally applied to the typical types 1 and 2 can be evaluated as a great progress that can overcome many of the problems of previous precedents in terms of securing legal stability.
