최근 한국 사회에서는 정의와 공정을 둘러싼 수많은 의견이 분출하고 있다. 그러한의견들은 제각기 서로 다른 정의 개념에 기초하고 있다. 이 글에서는 서구의 주요정의론을 살펴보고 그동안 쟁점이 되었던 문제들에 대한 재검토를 통해 올바른정의론을 정립하고, 정의로운 사회를 구현할 수 있는 길을 모색해보고자 하였다. 그동안의 서구 정의론을 더듬어보면 많은 논자들이 종종 지나치게 한쪽으로 치우친견해만을 고집하고 자기와 다른 견해를 배격하는 데서 문제가 발생한다는 것을알 수 있다. 이 글에서는 그동안 대립해 온 윤리 도덕 사상과 정의론들이 어떤편향성을 가지고 있으며 거기로부터 어떤 문제가 발생하는가를 밝히고, 그런 문제들을 해결하기 위해서는 서로 대립적인 것으로 간주 되어 온 견해들을 불이不二적관점에서 통합할 필요가 있다는 것을 밝히고자 하였다. 이것은 개인과 공동체(사회), 동기와 결과, 의무와 목적, 옳음과 선 등을 대립적으로만 볼 게 아니라, 서로 불가분의관계에 있는 것으로 보는 관점에서 통합해야 한다는 것이다. 이 글에서는 그런관점에서 공리주의와 의무론, 자유주의와 공동체주의의 상호 배척이 아닌 상호보완적 통합이 필요하다는 것을 밝혔다.
Recently, in Korean society, numerous opinions are erupting around the issue of justice. Such opinions are based on different concepts of justice. In this article, I tried to examine the major theories of justice in the West, to establish a correct theory of justice and to find a way to realize a just society by reviewing the issues that have been at issue. Looking at the Western theories of justice, we can see that the problem arises from many scholars often insisting on views that are too biased to one side and rejecting views that are different from their own. In this article, I tried to reveal what kind of biases the ethical moral ideas and theories of justice that have been opposed so far have and what problems arise from them. In order to solve such problems, I tried to clarify that it is necessary to integrate the views that have been regarded as opposed to each other from an indistinguishable point of view. This means that the individual and the community (society), motives and results, duties and purposes, right and good, etc., should be integrated from the viewpoint of not only looking at them in opposition, but as being inseparable from each other. In this paper, it has been revealed that from that point of view, it is necessary to integrate complementary and complementary rather than mutual exclusion of utilitarianism and deontology, liberalism and communitarianism.
