What are the success factors of the sanction against Banco Delta Asia (BDA)? In 2005, the US Department of Treasury sanctioned BDA for alleged money laundering related with the North Korean regime. Although the executed sanction complicated international relations and had a controversial outcome, it was a significant case in preventing North Korea from illegal economic activities while also influencing the six-party talks for solving the Korean peninsula nuclear issue. Therefore, this research analyzes the BDA case based on current theories of economic sanctions. First of all, the research designs a framework of analysis by reviewing explanatory factors for the success of sanctions in three aspects: environment, design, and execution of economic sanctions. Based on the framework, it analyzes the critical factors for the success of the BDA sanctions. At the end, the BDA case satisfied several conditions for success in the aspect of designing and executing a sanction, while it fails to satisfy success conditions in regards to the aspect of environment. The sanctions were effective because the US clarified the target by identifying the economic network related to the North Korean leadership and they could reduce unnecessary collateral damages by executing financial sanctions in a short period of time. Furthermore, the US was successful in making individual financial institutions participate in the sanction by organizing an effective sanction network based on US economic hegemony and the transparency of the international financial system. Finally, the swift execution of sanction did not allow North Korea to prepare to absorb the impact of the sanctions and which in turn made the mechanism more effective.
방코델타아시아(BDA) 제재의 성공 요인은 무엇인가? 2005년 미 재무부는 북한의 불법자금유통과 관련하여 BDA를 제재하였다. 이 사건은 매우 복잡한 국제정치적 맥락속에서 진행되었으며 그 결과 대해서도 의견이 분분하다. 그러나 이 제재는 북한의 불법경제활동 중단에 결정적인 효과를 보였으며, 북핵협상 측면에서도 북한에게 큰 영향을 미친 중요한 사건이었다. 따라서 본 연구에서는 기존 제재이론들을 중심으로 BDA 제재를 측면하였다. 먼저, 기존 이론연구들에서 제시하는 제재의 성공요인들을 환경적, 설계적, 이행적 측면으로 구분하고, 이 틀을 바탕으로 BDA 제재를 분석하였다. 그 결과 BDA 제재는 환경적으로는 좋은 조건을 갖고 있지 않았지만, 설계와 이행측면에서는 많은 성공요인들을 갖고 있었다. 북한의 정권과 연결된 경제네트워크를 파악하여 제재 대상을 구체화 하였으며, 금융영역을 표적으로 단기간에 제재를 이행하여 기타 불필요한 피해를 줄일 수 있었다. 또한 미국의 경제패권과 국제금융기관의 투명성에 기반하여 효과적 제재 네트워크를 구성하여, 국제 금융기관들이 참여할 수 밖에 없도록 만들었다. 그리고 신속하게 제재를 이행하여 북한이 이에 대비할 시간을 주지 않아 그 효과를 높였다.
