여러 가지 공통점을 공유하는 스페인과 포르투갈은 인접한 국가들에비하여 일찍 유럽을 벗어나 다른 대륙에서 광활한 영토를 식민지로 삼기시작하였다. 1492년 유럽인이 아메리카 대륙에 도착하면서 16세기부터본격적으로 식민 지배가 시작되었으며, 식민지 경쟁의 결과로 많은 경계선 획정을 위한 조약들이 체결되었다. 토르데시야스 조약으로 스페인과포르투갈 사이에 식민지 영역의 경계가 만들어진 이후 양국의 식민지 경계선은 변화하였다. 이후 1750년 1월 13일에 체결한 ‘마드리드 조약’(Tratado de Madrid)은 스페인과 포르투갈이 반다오리엔탈(Banda Oriental) 지역에서 일어나는 분쟁과 충돌을 막기 위해 체결한 조약이다. 두 제국은 이 조약을 통해서 식민지 영토에 대한 소유권과 관련된 다양한사항들을 합의하였다. 이 조약을 통해서 양국 사이에는 평화적인 식민지대 상황이 구축되었지만, 이들의 식민지에 대한 지배와 착취는 더욱 공고히 되었다. 본 연구는 스페인과 포르투갈이 라틴아메리카에 대한 식민화정책을 추진하는 과정에서 체결된 조약들을 살펴보고, 역사적·법적 의미와 함께 파생된 사회적 현상들을 파악하고자 한다. 특히 반다오리엔탈 지역의 영토 분쟁과 갈등을 해결하기 위하여 체결된 마드리드 조약의 배경과 특성을 살펴보고, 그 핵심 쟁점을 분석하여 그 의미와 시사점을 고찰하고자 한다.
Spain and Portugal had left Europe in advance of neighboring countries and started to preoccupy own colonies on other vast continent. Besides the colonization, these two countries showed several common things in different aspects. In 1492, European people arrived on Americas and colonization took place from 16th century. Consequently, many treaties to set a specific boundary were signed. Treaty of Tordesillas had resulted in first colonial boundary between them but it also had a meaning to start following territorial dispute. ‘Madrid Treaty’ (Tratado de Madrid) was formally signed in 1750 by Spain and Portugal to deal with troublesome conflicts and struggles on Banda Oriental. These two empires made some conclusion with the articles on the Madrid Treaty about the ownership of their colonies. The treaty temporarily contributed to sustain peaceful colonialism but their domination and exploitation on own colonies were strengthened at the same time. This research has an purpose of understanding several treaties which were contracted along the way that Spain and Portugal leaded colonial war on Latin America, and figures out some social phenomenons caused from them and understands historical and legal aspect. Specifically, this article goes over the background and feature of the Madrid Treaty to deal with some conflicts and struggles on Banda Oriental. Furthermore, it goes through the main point and contemplate the meaning and implication of them.
