대한변협이 발행하는 유서 깊은 학술지인 「人權과 正義」는 매년 봄이면 법조 실무가들을 위하여 전년도에 선고된 중요 판례를 각 분야별로 선별해서 특집으로 게재하고 있다. 이 판례평석은 2022년에 나온 商法상 운송법과 보험법 관련 대법원의 판례 위주로 중요한 것을 엄선해서 판례 속에 들어 있는 쟁점에 대해 분석하고 이를 평가한 것이다. 그래서 운송법에서 1건, 보험법에서 5건을 선정했다. 판례평석인 만큼 법이론적 측면보다는 기존에 나온 판례 중심으로 비교 검토하였다. 하지만 필자의 관점에 따라 중요 판례를 선정 분석하였기 때문에 논자에 따라서는 동의하지 않을 수도 있을 것이다.
「Human Rights and Justice」, a historic academic journal published by Korean Bar Association, selects and publishes important precedents sentenced in the previous years for legal practitioners every year spring. This judicial review introduces and analyses some issues of major decisions of the Supreme Court in 2022 focusing on transportation law and insurance law of commercial law. So writer has selected 1 case from transportation law and 5 cases from insurance law. As it is judicial review, it focuses on existing precedents rather than legal theory aspects. However, since major cases were selected from the writer’s viewpoint, some readers might disagree with these selections.
