일반건물인 주택전세권자의 대항력 범위는 주택임차권과 비교하여 고찰할 때 사실 그에 미치지 못하는 부분이 있다. 실상은, 같은 주거용 건물이라는 동일한 객체에서 세입자가 추구하는 ‘주거생활의 안정’이라는 목적이 다를 수 없다. 그렇다면 그 법적 효과의 차이를 둘 명분이 또한 적다는 것이다. 따라서 본 논문에서는 주택전세권자의 대항력 범위의 확장 가능성의 관점 에서, 다음과 같은 네 가지를 제시하였다. ① 먼저, 1동건물 전부에 대한 부 분전세권자의 경매청구권을 인정할 필요가 있으며, ② 다음으로, 그 1동건물의 전세권주택에게도 대지의 매각대금에서 우선변제권을 허용하는 것이 무방하다는 것이다. ③ 나아가, 현행 민사집행법 제91조 제4항 단서의 규정에서, ‘전액배당’을 전제로 전세권이 매각으로 소멸되도록 수정하는 방향의 입법적 개정을 촉구하였다. ④ 이에 더하여, 최선순위 주택전세권자가 법정 갱신시 변경등기는 단독신청에 의하여 신속한 권리행사가 가능하도록 현행 부동산등기 법 제23조 제9항에 별도로 이를 신설할 것을 제안하였다. 이로써, 주택전세권자의 권리실현이 보다 실질적인 현실화에 조금 더 접근 하길 기대한다.
When considering the scope of the opposing power of the housing Junsekwonholder, which is a general building, compared to the housing lease right, there is actually a part that is less than that. In fact, the purpose of ‘stability of residential life’ pursued by tenants in the same object of the same residential building cannot be different. If so, there is also less justification to make a difference in the legal effect. Therefore, in this paper, from the perspective of the possibility of expanding the range of opposing power of housing Junsekwonholder, the following four things were suggested. ① First of all, it is necessary to recognize the right to claim the auction of the partial housing Junsekwonholder for all of the building 1-dong, ② and Next, it is safe to allow preferential repayment rights from the sale price of the land in the housing Junsekwon of the building 1-dong. ③ Furthermore, the provisions of the proviso to Article 91 (4) of the current Civil Execution Act urged a legislative amendment to amend the Junsekwon to be extinguished by sale on the premise of ‘full dividend’. ④ In addition, it was proposed to establish a separate registration in Article 23(9) of the current Real Estate Registration Act so that the highest-ranking housing Junsekwonholder can exercise his/her rights quickly by applying for a legal renewal. As a result, it is expected that the realization of the rights of housing Junsekwonholder will approach more substantial realization.
