현행 성범죄의 처벌규정 체계는 최협의에 이르는 폭행･협박에 의한 강간을 기본적 구성요건으로 함에 따라 비동의간음행위, 위력에 의한 권력형 성범죄 등에 대한 처벌의 공백이 발생하고, 성범죄의 기본법인 「형법」에서 최근 많은 문제가 되고 있는 비접촉(비신체적) 성범죄를 전혀 규율하지 못한 채 사회적 이슈가 생길 때마다 법체계 전반에 대한 체계적인 검토 없이 단편적으로 특별법에 처벌규정을 개정 또는 신설하고 있으며, 「형법」과 특별법의 처벌규정의 혼재로 인하여 실무상 구체적 사건처리에 있어 법률 적용(적용법조)의 혼란과 형벌의 불균형 등의 문제도 발생하고 있고, 최근에는 메타버스 상에서의 성범죄 문제도 대두되고 있는 실정이다. 이에 현행 성범죄 처벌규정 체계의 근본적인 문제점에 대한 비판적 성찰과 연구를 통해 성범죄의 보호법익인 ‘성적 자기결정권을 충실하게 보호할 수 있도록 하는 방향으로의 성범죄의 처벌규정 체계’를 다시금 모색할 필요가 있다. 성범죄의 보호법익으로서의 성적 자기결정권은 그 의미를 ‘인격권의 주체로서 스스로 선택한 인생관･사회관 등을 토대로 개인과 공동체의 상호연관 속에서 확립한 독자적인 성적 관념을 바탕으로 성적 행위를 할 권리’라고 적극적으로 이해하고, 이러한 성적 자기결정권을 행사함에 있어서는 ‘자신과 타인을 동등한 존재로 여기며 성적으로 존중해야 하고, 상대방을 성적 대상화하여서는 안 되는 것’으로 해석해야 하며, 이를 바탕으로 성범죄의 개념을 새롭게 정립하고 성범죄의 처벌규정 체계를 재구조화 함으로써 문제점을 해결해야 한다. 이러한 재구조화 방안으로는 비동의간음죄의 도입을 통한 성적 자기결정권 보호에 부합하는 처벌규정 체계 마련,「형법」상의 표제 개정을 통한 비접촉(비신체적) 성범죄의 「형법」으로의 포섭, 디지털 성범죄에 있어서 ‘성적 수치심’ 삭제 및 ‘성적 대상화’로의 재구조화, 처벌규정의 통합, 메타버스의 특성을 반영한 새로운 형사처벌 규정의 모색 등이 있다.
The current punishment regulations system for sexual crimes has a problem of failing to punish sexual intercourse without consent, and a problem of not regulating non-physical sexual crimes in the criminal law. In addition, there are problems of amending or newly establishing punishment regulations piecemeal without systematic review of the overall legal system, and confusion in the application of the law in handling specific cases. Recently, the issue of sexual crimes on the metaverse is also emerging. Therefore, through critical reflection and research on the fundamental problems of the current punishment system for sexual crimes, it is necessary to seek again the ‘punishment regulation system for sexual crimes in the direction of faithfully protecting the right to sexual self-determination'. The right to sexual self-determination is actively understood as 'the right to engage in sexual acts based on one's own sexual notions', and in exercising this right to sexual self-determination, 'one must regard oneself and others as equals and respect them sexually, and should not be sexualized, and based on this, the concept of sexual crimes should be newly established and the punishment system for sexual crimes should be restructured to solve the problem. Such restructuring measures include the introduction of the crime of adultery without consent, the revision of the title of the 「Criminal Act」, the elimination of ‘sexual shame’ in digital sexual crimes, the integration of punishment regulations, and the search for new criminal punishment regulations that reflect the characteristics of the metaverse.
