인간이 가정의 행복을 확보하는 중요한 장소는 주거 공간이다. 그러나 현재 많은 주택은 행복하게 살 수 있는 면적의 크기나 안락한 상태가 아닌 경우가 많다. 주택이 현재와 같은 상태로 된 것에는 여러 가지 원인이 있을 것이다. 그 근본 원인은 국민도 인간생존의 기반인 주거를 인간으로서 살아가기 위한 기본적 권리로 인식하지 않았기 때문이라고 생각이 든다. 주거가 인권이라고 생각하는 사람은 아직도 적어 보인다. 민주주의와 인권사상이 서서히 침투하고 다방면에서 인간으로서의 권리가 확립되어 가고 있지만, 열악한 주택에서 살수 밖에 없는 사람들은 스스로 능력이 없다고 체념해 버리는 경우도 있다. 만약 인간으로서 살아감에 있어 불가결의 권리라고 생각한다면, 그 권리를 얻기 위해 투쟁하게 될 것이다. 여러 가지 주택인권 운동의 참가를 통해서 국민의 의식이 변하는 과정이 있었던 것이 아닐까 한다. 주거상태를 개선하기 위해서는 국민 스스로가 의식의 변화가 가장 중요한 것이 아닌가 한다. 복지는 국가 혹은 지방자치단체 등 행정에 의한 정책과 그 실행력에 크게 의존해 왔다. 자본주의 체제하에서 생존적 기본권이 법에 기초해서 운용된 것은 국민의 생존을 위협할 만큼 심각한 상황이 사회전반에 초래되었거나 혹은 국민의 입장에서 설득력 있는 논리와 실천을 동반한 운동이 활발히 전개된 때이다. 주택 그 자체가 생존을 위협하는 상황을 발생시킨다 해도 그러한 주거위기를 극복하는 것은 개인의 능력으로 하는 우리 사회의 이데올로기는 주택인권의 이념과 정면으로 대립하는 것이다. 따라서 주택인권은 국민의 동의에 기초해서 법제도로 확립하여 운용하는 것이 필요하다.
An important place for humans to secure family happiness is a residential space. However, many houses today are often not in a comfortable state or the size of the area to live happily. There must be a several reasons why the house is in the current condition. I think the root cause is that the people did not recognize housing, which is the basis for human survival, as a basic right to live as a human being. Democracy and human rights ideology are slowly penetrating and human rights are being established in many ways, but people who have no choice but to live in poor housing sometimes resign themselves as incapable. If you think it is an indispensable right to live as a human being, you will struggle to obtain that right. There may have been a process of changing the consciousness of the people through the participation of various housing rights movements. In order to improve the housing condition, the people themselves think that the most important thing is to change their consciousness. Welfare has relied heavily on administrative policies such as the state or local governments and their ability to implement them. Under the capitalist system, survival basic rights were operated based on the law when a situation serious enough to threaten the survival of the people was caused in general society, or a movement with persuasive logic and practice was actively developed from the perspective of the people. Even if housing itself creates a situation that threatens survival, overcoming such a housing crisis is the individual's ability, and the ideology of our society is in direct opposition to the ideology of housing human rights. Therefore, it is necessary to establish and operate housing human rights as a legal system based on public approval.
