한국의 해사법원 설립과 관련하여 학계와 실무계에서는 설립의 필요성을 강하게 주장하고 있다. 특히, 외화의 유출방지, 전문적인 법률서비스의 제공 및 해양강국으로서의 위상 등을 그 주된 이유로 들고 있다. 이러한 이유로 국회에서도 해사법원 설립에 관한 법률안이 발의되었다. 이렇듯 독립된 형태의 해사법원 설립에 대한 필요성에는 공감하고 있으나, 구체적인 운영방안 및 사건 심의 범위 등에 관한 구체적인 방안 등은 정해진 바가 없다. 따라서 1984년부터 독립적인 해사법원을 운영하고 있는 중국의 해사법원 재판시스템을 분석해 볼 필요성이 있다 할 것이다. 중국해사법원은 1984년에 독립적인 법률을 통해 6개의 해사법원이 설립되었고, 2019년까지 총 11개의 해사법원이 설치되어 운영되고 있다. 그리고 2016년 “해사법원 사건수리범위에 관한 규정”을 통해 108개의 해사법원 관할 사건범위를 확정하였다. 또한 재판관할과 관련하여서는 기본적 해사분쟁의 1심은 전문법원인 해사법원에서 심리하며, 2심은 그 해사법원이 소재한 고급인민법원에서 심리하고 있다. 아울러 전문관할, 전속관할, 토지관할 및 특별 토지관할 제도를 운영하고 있다. 이렇듯 전문적인 해사법원이 설립될 경우 전문성과 재판의 일관성이 어느 정도는 보장될 것이라고 생각한다. 그리고 해사법원의 설립 위치와 관련하여, 여러 논의가 있으나 중국의 경우를 통해 보면 중국은 해안을 중심으로 해사법원이 설치 운영되고 있으므로 이를 참고할 필요가 있다고 본다.
Regarding the establishment of Korea's maritime court, the academic and practical circles strongly insist on the need for establishment. In particular, the main reasons for Korea's maritime court are prevention of outflow of foreign currency, provision of professional legal services, and status as a maritime powerhouse. For this reason, the National Assembly also proposed a draft of a proposed law for establishment of a maritime court. We sympathize with the need for the establishment of an independent maritime court, however, there are no specific plans for operation and scope of deliberation on the case. Therefore, it is necessary to analyze China's maritime court trial system, which has operated an independent maritime court since 1984. Six maritime courts were established through independent law in 1984, and a total of 11 maritime courts have been established and operated by 2019. In 2016, 108 cases under the jurisdiction of the Maritime Court were determined through the "Regulations on the Scope of Repair of Cases of the Marine Court". In addition, the first trial of the basic maritime dispute is held at the Maritime Court, which is a professional court, and the second trial is held at the High Quality People's Court, where the maritime court is located. In addition, it operates specialized jurisdiction, exclusive jurisdiction, land jurisdiction, and special land jurisdiction system. I think the establishment of maritime court will guarantee professionalism and consistency in the trials. And there are many discussions regarding the location of the maritime court, but in the case of China, it is necessary to consider the fact that the maritime court is set up and operated around the coast.
