전 세계적으로 인공지능(AI), 블록체인, 빅데이터 등 정보통신기술(ICT)이 사회경제학적 발전의 핵심적인 요소로 대두되는 4차산업혁명이 큰 이슈가 되고 있다. 우리나라도 4차산업혁명의 변화에 대응하기 위해 국가 단위의 발전 전략을 마련하고 있다. 초연결시대에서는 산업, 행정, 문화영역의 데이터의 수가 폭발적으로 증가하고, 인공지능이 이러한 데이터를 스스로 학습하여 인간의 육체노동을 대체할 뿐만 아니라, 지적 판단기능도 수행이 가능해진다. 이에 따라 인공지능은 각국의 행정에까지 사용되고 있으며, 우리나라도 국가의 행정에 점점 진화되는 자동화된 시스템을 사용하기 위해 행정기본법에 그 근거를 마련했다. 이렇듯 많은 국가들이 행정에 자동화된 시스템을 도입하고, 자동화된 시스템에 의한 의사결정 영역을 넓혀가고 있다. 이러한 상황에서 특히 행정작용의 중심으로서 중요개념으로 인지되는 행정행위(처분)에 대해 절차적으로 검토할 필요가 있다. 따라서 본 논문에서는 행정기본법에 근거한 자동화된 의사결정에 대한 개념과 근거, 완전히 자동화된 의사결정, 비교법적 고찰로서의 해외 주요국 입법사례, 행정절차법상 쟁점 등을 중점적으로 검토해 본다.
The 4th industrial revolution, in which information and communication technology (ICT) such as artificial intelligence (AI), blockchain, and big data, is emerging as a key factor in socioeconomic development around the world, is becoming a big issue. In response to the 4th industrial revolution, Korea is preparing a national development strategy. The hyper-connected era of 4th industrial revolution see an explosion in the number of data from industrial, administrative and cultural domains, and AI will be able to learn this data on its own, replacing human labor, as well as performing intellectual judgment functions. Many countries have begun to apply AI to their administrative domains, and Korea has also laid its legal basis in the Basic Administrative Act to utilize an AI-based administrative system. Accordingly, artificial intelligence is being used even in the administration of each country, and Korea has also prepared the basis for the Basic Administrative Act to use the increasingly automated system for national administration. As such, many countries are introducing automated systems to their administration and expanding the scope of decision-making by automated systems. In this situation, it is necessary to review administrative (dispositions), which is an important concept in administrative action. Therefore, this paper will discuss the concept and rationale for automated decision-making based on the Framework Act on General Act On Public Administration, fully automated decision-making, legislative cases in major foreign countries as a comparative study, and issues under the Administrative Procedure Act.
