적격심사제는 우리나라 공공조달에서 가장 보편적으로 사용되는 경쟁입찰 방식 중 하나이다. 실제로 적격심사제에서 낙찰은 무작위로 선정된 예정가격에 의해 결정되기 때문에 운에 좌우된다고 할 수 있다. 이는 덤핑입찰뿐만 아니라 입찰담합을 막는 역할을 한다. 그럼에도 불구하고 적격심사제 공공조달에서 입찰담합은 여전히 벌어지고 있다. 본고는 적격심사제 입찰에서 기업들의 담합을 이론적으로 분석한다. 최적 담합의 행태를 분석하고 그 결과에 대해 논의한다. 이를 통해 경쟁당국의 적격심사제 입찰담합 규제에 대한 함의를 제공한다.
The qualification review auction is one of the most commonly used competitive bidding methods in public procurement in Korea. In fact, it can be said that the successful bid in the qualification review auction depends on luck because it is determined by the estimated price selected at random. This plays a role in preventing bid rigging as well as dumping bids. Nevertheless, bidding collusion is still taking place in public procurement of the qualification review auctions. This paper theoretically analyzes the collusion of companies in bidding for the qualification review auction. We analyze the characteristics of optimal collusion and discuss the results. Through this, it provides implications for the competition authorities' regulations on bid rigging for the qualification review auction.
