이전의 성범죄는 범죄자가 자신의 성적 만족을 위해 여성을 범죄대상으로 삼아 육체적인 성범죄를 저지르는 것이 대부분이었다. 그러나 제4차 산업혁명시대가 도래하면서 상당수 성범죄는 디지털화 하였고, 돈벌이와 결합하여 디지털 성범죄가 급격히 증가하는 추세이다. 한 걸음 더 나아가 범죄자는 세계 어느 곳에서든지 다크넷이나 텔레그램 등에 숨어서 자신의 신분을 드러내지 않고 수요자와 피해자를 통제하면서 추적이 어려운 암호화폐를 통해 손쉽게 디지털 성범죄를 범하고 있다. 아날로그 성범죄의 경우 국가기관의 물리적인 우위로 인해 예방과 진압이 상대적으로 용이하다. 그러나 디지털 성범죄의 경우 법률적 한계와 기술적 한계, 다크넷이나 텔레그램 및 암호화와 암호화폐 등을 통한 디지털 범죄 생태계 구축 등으로 인해 대응이 쉽지 않다. 지금 이 시간에도 디지털 범죄 생태계에서는 무수히 많은 디지털 성범죄가 발생하고 있지만 ‘n번방 사건’과 같이 범죄자가 확실하게 처벌되는 경우는 많지 않은 상황이다. 이는 현실공간에서는 수사기관의 힘이 범죄자들에 비해 우세하지만 사이버공간에서는 범죄자들이 수사기관의 힘을 기술적 방법으로 무력화 시킬 수 있기 때문이다. 그런 점을 고려하여 이번 연구에서는 독일에서 이미 범죄예방과 범죄진압을 위해 도입된 온라인수색의 도입 필요성과 도입 시 고려해야 할 사항들에 대해 고찰해 보았다. 현행 강제수사 방법으로는 점점 더 국제화되고, 은밀해지며, 기술 뒤로 숨어서 수많은 피해자들에게 씻을 수 없는 고통을 주고 있는 디지털 성범죄에 대응하기 어렵다. 디지털 성범죄에 대응하는 수사기관의 무능함을 탓하기 전에 수사기관이 디지털 성범죄에 대응할 수 있는 수단을 마련해야 한다. 온라인수색 도입에 대해 많은 시민들이 우려하고 위험감정을 가지고 있는 것은 당연하다. 그러나 적어도 디지털 성범죄에 대해서는 시민들의 합의가 이루어지고 있다고 판단된다. 그러므로 이제는 독일의 규정들과 활용상황, 한국의 강제수사 관련 규정들을 고려해서 온라인수색을 도입하는 방안을 보다 구체적으로 논의해야 할 것이다. 한국 사람들은 구체화가 필요한 사항에 대해 너무 추상적인 논의만을 진행하는 습성을 지녔다는 고 이어령 선생님의 마지막 수업을 곱씹어 볼 필요성이 있다. 지금도 디지털 성범죄자들이 수사망을 비웃으며 호의호식하며 살고 있는데 반해 범죄 피해자들은 지옥 속에서 하루하루를 살고 있다는 사실을 잊지 말아야 할 것이다.

Most of the previous sex crimes were committed by criminals in a physical way, targeting people for their sexual satisfaction. However, with the advent of the information society, many sex crimes are committed in cyberspace, resulting in a rapid increase in digital sex crimes. Criminals are freely committing sex crimes anywhere in the world, hiding in dark nets or Telegrams, controlling crime consumers and crime victims. In reality, sex crimes are relatively easy to prevent and suppress because investigative agencies have an advantage. However, in the case of digital sex crimes, it is not easy for investigative agencies to respond due to legal and technical limitations, and the establishment of a secret digital crime ecosystem. Considering that, this study examined the need to introduce online search, which has already been introduced in Germany for crime prevention and crime suppression. In addition, we analyzed the considerations when introducing online search. With the current forced investigation method, it is difficult to respond to digital sex crimes in which criminals are increasingly organized and secretly using high-level technologies. Before blaming the incompetence of the investigative agency responding to digital sex crimes, it is necessary to prepare a means for the investigative agency to respond to digital sex crimes. No wonder many citizens are concerned about the introduction of online searches. However, it can be said that at least citizens' agreement to respond strongly to digital sex crimes has already been reached. Therefore, it is now necessary to analyze the problems of online search in Germany and discuss in more detail how to introduce online search in accordance with Korean criminal procedures. It is more important to try, fail, and try again than to argue and produce no results.
