특허법 제128조 제4항은 ‘권리를 침해한 자가 그 침해에 의하여 이익을 받은 때에는 그 이익의 액을 특허권자가 받은 손해의 액으로 추정한다’고 규정하고 있다. 동 규정과 관련하여 특허침해가 발생하기 전 특허권자가 특허발명을 실시한 경우에만 동항을 적용하여 손해배상을 청구할 수 있는가, 즉 동 규정의 적용요건으로서 특허권자의 실시행위가 요구되는가가 문제된다. 이에 대하여 우리나라와 일본에서 많은 논의가 있었으며, 본 논문에서는 배상액의 산정에 관하여 우리나라와 거의 동일한 규정을 두고 있는 일본과 우리나라의 학설과 판례를 중심으로 동 규정의 적용요건으로 특허권자의 실시가 요구되는가에 관하여 살펴보았다. 이 문제에 대하여 일본의 경우는 특허권자에 의한 특허발명의 실시(제조, 판매 등)가 있어야 비로소 손해의 발생을 긍정할 수 있다는 실시필요설과 특허권자가 특허발명을 실시하고 있지 않다고 하더라도 특허발명과 경합하는 기술의 제품(경합제품)을 제조·판매한다면 족하다는 경합제품충분설이 대립하고 있다. 우리나라의 경우에도 동조 제4항의 적용을 위해서 특허권자의 실시가 필요하다는 실시필요설과 특허권자의 실시가 필요 없다는 실시불요설이 대립되고 있는 실정이다. 이에 대하여 침해행위가 없었다면 특허권자가 이익을 얻을 수 있었던 사정이 인정되는 경우에는 손해의 발생이 인정된다고 보아 특허 발명의 실시가 필수요건은 아니라는 일본의 知財高裁平成25年2月1日大合議判決이 우리나라의 특허법 제128조 제4항을 적용하는데에도 고려될 수 있다고 생각된다. 이에 따라 실시필요설의 입장에서 특허권자의 실시를 특허발명의 실시에 한정하지 않고 경합제품의 실시까지 그 범위를 확대하여(일본의 경합제품충분설), 특허권자가 특허발명을 실시하지 않고 경합제품을 실시였을 경우에는 특허권자의 실시가 있었던 것으로 보아 동항을 적용하고 경합제품의 실시조차 없는 경우에는 동항을 적용할 수 없다고 해석하는 것이 타당하다고 생각된다.
It has long been debated in the patent law of Japan and Korea whether the implementation of the patentee is required to apply the regulations(section 148 (4) of the Korea Patent Act, section 102 (2) of the Japan Patent Act) about calculating the infringer's profit as the amount of damage in the patent infringement. Both Korea and Japan are at odds with the argument that patentee's implementation(manufacturing or selling) is required on this issue and the argument that it is not. The Korean court did not directly mention the issue. However, a Japanese court judged that the regulation could be applied even if the patentee did not implement(manufacture or sell) a patent invention. There- fore, the regulation could be applied even if the patentee produced and sold competing products. I think that It is reasonable to apply this judgment of the Japanese court to the interpretation of Korean patent law. In conclusion, in order to apply the regulation, the patentee does not necessarily have to implement a patent invention, so the regulation can be applied even if a competing product is implemented.
