법에서 능력주의를 어떻게 다루어야 하는가? 하나는 능력주의/권력자격 그 자체를 직접 다루는 방법, 다른 하나는 권력자격/능력주의가 유발하는 부정적인 효과를 전유하여 이 문제를 다루는 방법 등을 생각해 볼 수 있다. 이 글에서는 능력주의/권력자격 테제를 직접 이 글의 분석대상으로 삼겠다. 이 테제는 ‘Intelligence and effort together make up merit(I + E = M)’이다. 이 글은 I와 E가 어떻게 관계를 맺고 있는지를 파악하는 것이다. 따라서 이것은 메타 형이상학적인 분석이다.
