북한이탈주민의 복지향상을 위한 법제 개선은 북한이탈주민의 법적 지위를 검토하는 것에서부터 출발하여야 한다. 북한이탈주민의 복지향상을 위한 근본적인 토대를 세우고, 개별분야에서의 제도개선의 당위성과 그 방향성을 점검하여 바람직한 법제 개선방안에 대해서 검토하고자 하였다. 북한이탈주민의 복지향상을 위한 법적 지위 검토에 있어, 북한을 국제법상의 국가로 인정할 것인지 여부가 문제된다. 북한이탈주민의 법적 지위를 ‘내국인’으로서 인정할 것인지, ‘외국인’으로 인정할 것인지에 따라 사회보장기본권으로서 인정되는 복지수급권의 범위가 달라질 수 있다. 외국인의 경우에도 인간으로서의 최소한도의 생존권적 기본권은 인정되며, 북한이탈주민에 대한 정책에 있어 다문화가족정책 등 사회통합을 위한 정책들의 연장에서 문화차이 등의 간극을 좁히는 정책들을 확대해야 한다는 정책방향성을 보다 잘 설명할 수 있는 측면도 있다. 단계적으로 시기와 범위에 대한 전략적 접근이 필요하다. 북한이탈주민법이 다른 법들의 특별법으로서만 기능하는 것으로는 그 한계가 있으며, 북한이탈주민에 대한 포괄적이고 전체적인 정책들을 조율하는 기능을 포함하여야 단기적 관점에서 사각지대에 놓인 북한이탈주민들을 지원하면서 동시에 장기적으로 대규모 유입 및 남북교류협력의 증대에 대한 대비도 가능하게 될 것이다. 북한이탈주민에 대한 정착지원에 있어, 사회통합적인 측면을 강화하고 있으나, 무조건적인 동화가 아니라 다양성 존중과 공동생존의 측면에서 또하나의 ‘다문화가족’의 측면도 간과해서는 안된다. 또한 수요자인 북한이탈주민의 입장과 선호를 고려하여 교육과 취업에서의 기회제공의 측면이 강화되어야 하며, 다양한 경험을 교육과정에서 접하게 하는 것이 교육과정에서 강조되어야 할 것이다. 또한 북한이탈주민의 정착지원의 정책에서 또 하나의 수요자인 같이살아가야하는 남한 주민의 참여와 수요도 고려해야 할 것이다. 다양한 문화들이 남한에 거주하면서 하나로 통합되어 가는 과정이 북한이탈주민에 대한 정책에서 구현되어야 할 것이다.
For improvement of legislative system to improve welfare of North Korean Defectors, the legal status of North Korean defectors should be reviewed. Forming the fundamental foundation for improving the welfare of North Korean defectors, it was intended to examine the appropriate legislative improvement measures by examining the justification and direction of institutional improvement in individual fields. It depends on whether the legal status of North Korean defectors is recognized as a 'national' or a 'foreigner', that the scope of the right to receive welfare benefits recognized as a basic social security right may vary. Even in the case of foreigners, the minimum basic right to live as a human being is recognized. In the policy on North Korean defectors, the policy direction should be taken from the extension of policies for social integration, such as the multicultural family policy. A strategic approach to time and scope is required in stages. There is a limit to the fact that the North Korean Defector Act only functions as a special law of other laws. It should include the function of coordinating comprehensive and overall policies on North Korean defectors. It supports North Korean defectors who are in the blind spot in the short term, at the same time, it will be possible to prepare for a large-scale inflow and increase in inter-Korean exchanges and cooperation in the long term. In terms of settlement support for North Korean defectors, the social integration aspect is being strengthened, but there should be a viewpoint of respect for diversity and co-existence, not unconditional assimilation. Another aspect of the ‘multicultural family’ should not be overlooked. In addition, the aspect of providing opportunities in education and employment should be strengthened in consideration of the position and preference of North Korean defectors who are consumers. Experiencing various experiences in the curriculum should be emphasized in the curriculum. The participation and demand of South Koreans, who must live together as another consumer, should be taken into consideration in the policy of support for North Korean defectors' resettlement. The process of integrating various cultures into one while residing in South Korea should be implemented in the policy on North Korean defectors.
