미디어 산업의 발전과 코로나19로 인해 교회의 미디어 플랫폼 활용이 급속도로 증가하였으며, 동시에 저작권 침해 문제를 경험하게 되었다. 이에 교회의 저작권 침해 문제의 심각성에 대한 인식과 그 해결방법에 관한 연구가 필요한 상황이 다. 본 연구의 목적은 교회가 온라인 예배를 드리기 위해 미디어 플랫폼을 활용할때 발생하는 예배음악 저작권 침해 문제에 대해 고찰하여 그 위험성을 알고 저작권 침해 문제에 대응할 수 있도록 그 해결방안을 제시하는 것이다. 이를 위하여 교회의 미디어 플랫폼 이용현황과 예배음악 관련 저작권 관리 단체 및 회사에 대해 알아보았으며, 특히 온라인 예배 시 가장 많은 저작권 침해가 일어나는 예배음악을 중심으로 저작물성, 저작자, 예배음악 저작물의 종류에 대해 알아보고 저작권과의 관계를 분석하여 저작권 침해가 가능한 행위에 관해 연구하였다. 또한, 대부분의 저작권 침해가 공중송신에 의해 발생하기 때문에 예배음악을 공중송신할 때 발생하는 저작권 문제와 국내외 현황에 대해 알아보았다. 이러한 연구를 통해 저작권 침해 문제에 대해 교회가 책임져야 할 법적 책임과 그 심각성이 상당함을 알 수 있었다. 교회가 저작권 침해 문제를 해결하기 위해 서는 이미 사용된 저작물이 저작권을 침해했는지 판단하기보다는 저작권을 확보한 저작물만을 사용해야 한다는 교회의 인식변화와 함께 저작권을 침해하는 행위에 대해 발 빠른 대응을 해야 한다. 또한, 향후 발생할 저작권 문제에 대한 근본적인 해결을 위해 교회뿐만 아니라 교단 차원의 움직임이 필요하고 다양한 저작권 교육과 정책, 입법을 통한 문제 해결이 필요함을 알 수 있다. 일반적으로 권리의 다발로 표현되는 예배음악 관련 저작권에 대해 이해하고 지킴으로써 저작권 침해 문제를 해결하고, 더 나아가 저작권법의 목적인 창작자의 권익 보호와 공정한 이용을 통한 예배음악의 문화 및 산업 발전에 이바지함은 물론, 새로운 선교지인 미디어 플랫폼 세상에 적법하게 예배음악을 활용하여 선교할 수 있도록 해야 한다.
The church’s use of media platform has been dramatically increasing because of development of the media industries and Covid-19 pandemic, and yet, the issue of copyright infringement is on the rise. Therefore, it is necessary to recognize the seriousness of copyright infringement by church and to study the solutions. This study aims at reviewing the issue of copyright infringement of church music when churches use media platforms for online worship and suggesting the solutions for knowing its danger and responding to the problem. For this, the status of churches’ use of media platform, and copyright managing groups and companies with regard to church music were studied, and especially, focusing on the church music which its copyright is most frequently infringed in case of online worship, the copyright, its holders, and types of church music as copyright were reviewed. And then, the behaviors which are likely to infringe copyright were studied by analyzing their relations with copyright. In addition, as most of copyright infringements occur because of public transmission, the issue of the copyright in public transmission of church music and the domestic and overseas cases were investigated. Through these researche, church’s responsibilities for copyright infringement and its seriousness were revealed. For churches to solve the issue of their copyright infringement, with their changes in perception that they should use the works which they get the licenses rather than judging if the used music infringed the copyright, they should respond quickly to the behaviors infringing copyrights. Also, for solving radically the issues of copyright infringement in future, it is necessary for denomination as well as church to respond to them, and various educations and policies about copyright, and solving the matter through legislation shall be made. In general, it is necessary to understand and observe the copyright with regard to church music expressed as bundle of rights, and to solve the problem, and furthermore, it is required to contribute to develop the culture and industry of church music through protection of copyright of their holders subjected for copyright laws, and their fair use, and to conduct missions using legally church music in the world of media platform, a new mission field.
