본고에서는 먼저 자율주행자동차의 개념 및 국내외의 입법동향을 고찰하고, 이어서 자율주행자동차 사고의 민사상 책임에 대해 제조물책임법상 제조업자의 제조물책임과 자동차손해배상보장법상 운행자의 손해배상책임의 중요한 법률문제들을 검토하고 그 해결방법들을 모색하였다. 기존의 일반자동차 사고의 경우에 피해자들은 자동차손해배상보장법에 따른 자동차책임보험 등을 통해 비교적 적절하게 구제되어왔다. 그러나 자율주행자동차 사고의 경우에는 다양한 원인으로 사고가 발생하고 수동주행모드와 자율주행모드로 운행되므로, 자동차손해배상보장법상 운행자의 손해배상책임을 인정할 수 있는지가 문제되었다. 이에 대해 자동차손해배상보장법을 개정하여 보험회사가 피해자에게 먼저 보험금을 지급하고 추후 제조업자 등 책임자에게 구상할 수 있는 규정을 신설하였다. 자율주행기술의 발전으로 운전자의 개입이 줄어들게 되면, 자동차손해배상보장법상 운행자의 손해배상책임을 묻기는 점차 어려워지고 제조물책임법상 제조업자의 제조물책임을 묻는 것이 보다 적합하다고 보여진다. 자율주행자동차의 결함으로 인한 사고의 책임을 제조사에게 모두 묻게 되면 자율주행자동차의 개발이 저해될 수 있으므로, 제조물책임보험의 운영 등과 같은 해결방법도 필요하다. 우리나라의 현행 법령만으로는 자율주행자동차 사고의 피해자를 적절하게 구제하기에는 아직 부족하므로, 현행 법령의 적용상 문제점들을 세밀하게 검토하여 현행 법령을 체계적으로 재정비할 필요가 있다. 결국 자율주행자동차 사고의 민사상 책임은 상용화되는 자율주행자동차 단계에 따른 적절한 법제의 정비가 필요하고, 이를 위해 자율주행자동차에 관한 기술적 이해를 바탕으로 한 법률적 검토가 요망된다.

In this study, I examine the liability of autonomous car accident on Korean Act. There are the Motor Vehicle Management Act, the Act on the Promotion of and Support for Commercialization of Autonomous Driving Motor Vehicles, the Guarantee of Automobile Accident Compensation Act and the Product Liability Act. In the Motor Vehicle Management Act, the term “autonomous driving motor vehicle” means a motor vehicle which can self operate without any operation by its driver or passenger. In the Act on the Promotion of and Support for Commercialization of Autonomous Driving Motor Vehicles, the term “autonomous driving motor vehicle” means a motor vehicle which can self-operate without any operation by its driver or passengers, as defined in subparagraph 1-3 of Article 2 of the Motor Vehicle Management Act. In the Guarantee of Automobile Accident Compensation Act, where any person who operates a motor vehicle for personal use has killed or injured another person by such operation, he/she shall be liable to compensate the damages therefrom on the liability for damage caused by motor vehicles. In the Product Liability Act, a manufacturer shall compensate for damages to the life, body or property of a person caused by a defect of a product (excluding damages inflicted only to the relevant product). To solve related legal problems, we must study into the technical and structural characters of autonomous car. We should also consider and analyze the legislative examples of other countries.
