통일을 대비한 보건의료 지원과 협력을 도모하기 위해서는 다양한 노력이 필요하다. 그러한 노력 중의 하나가 의료법과 같은 개별 법률의 통일을 통한 남북한의 법의 통합이라 할 수 있다. 우리나라 법제도의 헌법·법령·규칙(조례·규칙)과 유사하게 북한의 법제도도 헌법·부문별법·법률 등의 위계질서를 갖고 있다. 따라서 북한의 헌법, 인민보건법 및 의료법과 남한의 헌법, 보건의료기본법, 의료법 등의 법체계률 비교할 수 있다. 남한은 해방 이후 자본주의 체제에서 사회적 시장경제 질서와 복지국가 이념에 입각한 보건의료체계를 발전시켜 왔지만 북한은 계획경제질서의 사회주의 체제하에서 북한 인민의 건강은 노동력 보장의 필수 요소로 인식하고, 의료 시스템을 국가가 전적으로 담당하여 왔다. 이와 같이 75년이라는 분단의 기간 동안 의료법제는 반대 방향으로 발전해 왔기에, 많은 이질성이 존재하며, 분단이 계속된다면, 차별의 간격은 점점 커져갈 것으로 전망된다. 그러므로 비록 남북한의 통일은 미래의 일이기에 예측하는 것이 어렵지만, 법학자로서 남북한 통일의 기반을 강화하기 위한 노력으로서, 그리고 통일이 되었을 경우에 부정적인 영향을 최소화하기 위하여, 본 논문에서 남북한의 의료법 체계를 분석하고 통일의료법 제정을 위한 방안을 연구하였다.
Various mearsures are needed to promote health and medical support and cooperation in the run-up to unification, . One of such efforts is the unification of South and North Korean laws by unifying individual laws such as medical law. Similar to the constitution, statutes, and rules (ordinances and rules) of the South Korean legal system, the North Korean legal system features a hierarchical order of constitution, sectoral laws, and laws. Thus, North Korea's constitution, the People's Health Act, and the Medical Act can be compared to South Korea's Constitution, the Framework Act on Health and Medical Services, the Medical Service Act, and other legal system laws. Since its liberation, South Korea has developed a health-care system based on the capitalist system's social market economic order and welfare state ideology. On the other hand, North Korea recognized the health of the North Korean people as an essential element of guaranteeing a labor force under the socialist system of a planned economic order, and the state exercises complete control over the health care system. As a result, the medical law systems of both North and South Korea have evolved in opposite directions over the 75-year divide, resulting in many heterogeneities, and if the division continues, the gap is expected to widen. Therefore, while it is hard to predict the unification of North and South Korea because it is a future event, as a legal scholar, in an effort to strengthen the foundation for the unification and to mitigate the negative impact in the event of unification, in this paper I analyzes the medical law systems of South and North Korea and study possible ways to enact the Unified Medical Act.
