현행「행정소송법」은 본안 소송이 취소소송과 무효등확인소송인 경우에 본안소송이 종결될 때까지 잠정적으로 처분 등의 효력이나 그 집행 또는 절차의 속행을 정지하게 하는 이러한 ‘집행정지’를 예외적으로 인정하고 있는데, 여기서 문제는 우리 법원이 행정소송법이 집행부정지를 원칙으로 함에 따라 공권과 다퉈야 하는 국민이 행정소송을 제기하는 경우에 상대적으로 불리한 위치에 있게 되는 점을 감안하여 집행정지 신청이 있으면 거의 예외 없이 집행정지를 관행적으로 받아주고 있다는 점이다. 우리 정부는 약가인하 정책을 추진하고 있는데, 오리지널 약품을 판매하는 외국계 제약사들은 정부의 ‘약제상한금액조정처분’에 대하여 그 취소를 구하는 행정소송을 제기하면서, 동시에 해당 처분의 효력정지를 구하는 집행정지를 신청하는 기조를 유지하고 있는데, 이는 우리 법원이 종래의 집행정지 인용관례를 이러한 경우에도 적용하여 집행정지 신청이 있으면 으레 이를 인용해주고 있어 가능하다 할 것이다. 집행정지 후 상고심까지 진행이 되면 많은 경우 3년 이상의 기간이 소요되고, 이 집행정지기간 동안 외국계 제약사들은 시간을 벌면서 정부의 약가인하조치에 제동을 걸고, 그 기간 동안 건강보험 재정을 악화시키는 악순환이 지속되고 있다 할 것이다. 최근 국회는 관련하여 제약사의 약가인하 처분 관련 소송의 남용으로 인한 건강보험 재정손실을 방지하고자 이를 법적으로 방지하고자 하고 있다. 이에 본 연구는 이러한 문제의식을 가지고 약가인하 적용 지연이 국민건강보험의 재정누수를 초래하는 만큼 약가인하 소송 관련 집행정지제도와 관련 사례들을 분석함으로써 개선방안을 제시하고자 한다.
The current Administrative Litigation Act exceptionally recognizes the effect of disposition, execution, or suspension of proceedings until the main lawsuit is terminated in case the main lawsuit is canceled or invalid. The Korean government is pushing for a drug price reduction policy, and foreign pharmaceutical companies selling original drugs are filing administrative lawsuits seeking cancellation of the government's "Drug Price Reduction Litigation" and at the same time applying the existing suspension. If the appeal proceeds after suspension of execution, it will take few years, and during this suspension period, the foreign pharmaceutical companies will continue to put a brake on the government's drug price reduction measures and worsen the national health insurance finances. Recently, the National Assembly has tried to legally prevent the financial loss of health insurance due to abuse of lawsuits related to drug price reduction litigation by pharmaceutical companies. Therefore, with this awareness of the problem, this paper focuses on how to present improvement measures by analyzing the current suspension system and the related cases related to drug price lawsuits as delays in drug price reduction cause financial leaks in the national health insurance.
