· 연구 주제: 이 연구의 목적은 최근 고소·고발 남용사건이 증가추세에 있으며 나아가 민사상의 고발이 증가하면서 수사 인력이 낭비되고 있다는 점에 착안하여, 이에 대한 대처방안에 연구의 중점을 두었다. · 연구 배경: 고소·고발 남용사건은 개인분쟁을 넘어 다수 또는 집단에 의한 고발 사건이 증가하는 추세이다. 일부 시민단체에서는 '고발' 현상을 통해 이들의 존재를 알리고 있는 실정에 있어, 이에 대한 대처방안이 모색될 필요가 있다. · 선행연구와의 차이점: 그 동안 고소·고발 남용사건의 폐해에 대한 선행연구는 부분적으로 전개되어 왔다. 그러나 그 대처방안에 대한 제시는 미미한 편이었다. 이에 향후 고소·고발 사건에 대한 공탁금제도를 구현하고 민·형사 조정, 중재사건으로의 전환, 탐정 회부 등 구체적으로 다양한 방법을 제시하였다. · 연구방법: 2020년 경찰청 감사 자료에 따르면 2019년 고소·고발 기소율은 18.2%, 이를 제외한 나머지 사건의 기소율은 최근 5년간 평균 40.8%였다., 이에 경찰청 통계자료. 법무부 법률연감 자료 외에도 관련 사례를 연구방법으로 원용하였다. · 연구결과: 경찰이 현재 범람하는 민원과 고발에 대처하기 위해 운영하고 있는 제도는 '반려제도'와 '수사민원상담센터' 운영이다. 이와 아울러 민사형 형사고소를 접수한 경우, 공탁금제도를 구체화하는 등 실질적인 여러 방안을 통해 명확히 제시할 필요에 대한 연구결과를 도출하였다. · 공헌점 및 기대효과: 연구를 통해 불필요한 형사 사건을 사전에 예방함으로써 수사 인력의 낭비를 방지할 수 있을 것이다. 나아가 국민의 일상생활 간 불안을 줄이고 신뢰를 회복할 수 있을 것이다. 궁극적으로 고소·고발의 남용 사례에 대한 실질적 제한으로 향후 효율적으로 대처할 수 있을 것이다.
